Section 272.2, subsection 14, Code 2005, is 1 2 amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. e. In addition to the penalty established 1 4 for a violation of section 126.3, subsection 23, the board 1 5 shall suspend or revoke the license, certificate, or coaching 1 6 authorization of a person for up to three years upon the 1 7 board's finding by a preponderance of evidence that the person 1 8 willfully and knowingly, with the intent to compromise the 1 9 outcome of an athletic competition, procured, sold, or 1 10 administered an anabolic steroid, as defined in section 126.2, 1 11 or caused such drug to be procured, sold, or administered, to 1 12 a student, or failed to report the use of such drugs by a 1 13 student to the administrators of a school district or 1 14 accredited nonpublic school. 1 15 Sec. 2. Section 280.13, Code 2005, is amended to read as 1 16 follows: 1 17 280.13 REQUIREMENTS FOR INTERSCHOLASTIC ATHLETIC CONTESTS 1 18 AND COMPETITIONS. 1 19 1. A public school shall not participate in or allow 1 20 students representing a public school to participate in any 1 21 extracurricular interscholastic athletic contest or 1 22 competition which is sponsored or administered by an 1 23 organization as defined in this section, unless the 1 24 organization is registered with the department of education, 1 25 files financial statements with the department in the form and 1 26 at the intervals prescribed by the director of the department 1 27 of education, and is in compliance with rules which the state 1 28 board of education adopts for the proper administration, 1 29 supervision, operation, adoption of eligibility requirements, 1 30 and scheduling of extracurricular interscholastic athletic 1 31 contests and competitions and the organizations. 1 32 2. An organization that meets the requirements of 1 33 subsection 1 shall develop, implement, and enforce rules that 1 34 make a student who is a member of a school athletic team 1 35 ineligible to compete in interscholastic athletic competition 2 1 for two consecutive school years if it has been determined by 2 2 the administrators of a school district or an accredited 2 3 nonpublic school that the student athlete used an anabolic 2 4 steroid, as defined in section 126.2, during the training 2 5 period immediately preceding or during the sport season of the 2 6 athletic team for which the student athlete competed, unless 2 7 the anabolic steroid was prescribed for a medical condition by 2 8 a physician licensed pursuant to chapter 148, 150, or 150A, or 2 9 a physician assistant licensed pursuant to chapter 148C. 2 10 3. For the purposes of this section "organization" means a 2 11 corporation, association, or organization which has as one of 2 12 its primary purposes the sponsoring or administration of 2 13 extracurricular interscholastic athletic contests or 2 14 competitions, but does not include an agency of this state, a 2 15 public or private school or school board, or an athletic 2 16 conference or other association whose interscholastic contests 2 17 or competitions do not include more than twenty=four schools. 2 18 EXPLANATION 2 19 This bill establishes penalties for anabolic steroid use by 2 20 a student athlete and for the procurement, sale, or 2 21 administration of an anabolic steroid, with the intent to 2 22 compromise the outcome of an athletic competition, by a person 2 23 who holds a license, certificate, or coaching authorization 2 24 issued by the board of educational examiners. 2 25 The bill provides that the board shall suspend or revoke 2 26 the license, para=educator certificate, or coaching 2 27 authorization of a person for up to three years upon the 2 28 board's finding by a preponderance of evidence that the person 2 29 willfully and knowingly, with the intent to compromise the 2 30 outcome of an athletic competition, procured, sold, or 2 31 administered an anabolic steroid or cause such drug to be 2 32 procured, sold, or administered to a student athlete, or 2 33 failed to report the use of such drugs by a student to the 2 34 administrators of a school district or accredited nonpublic 2 35 school. 3 1 The bill requires an organization that sponsors or 3 2 administers extracurricular interscholastic athletic contests 3 3 or competitions for students enrolled in a school district or 3 4 accredited nonpublic school to develop, implement, and enforce 3 5 rules making a student athlete ineligible for interscholastic 3 6 competition for two school years if the school district or 3 7 school's administrators determine that the student athlete 3 8 used an anabolic steroid during the training period 3 9 immediately preceding or during the sport season of the 3 10 athletic team for which the student competed, unless the 3 11 steroid was prescribed by a physician or a physician assistant 3 12 for a medical condition. 3 13 The Code currently prohibits the selling, dispensing, or 3 14 distributing; causing to be sold, dispensed, or distributed; 3 15 or possessing with the intent to sell, dispense, or 3 16 distribute, an anabolic steroid to a person under 18 years of 3 17 age, with knowledge that the anabolic steroid is not necessary 3 18 for the legitimate treatment of disease pursuant to an order 3 19 of a physician.
