1 An Act relating to services and providers included under the
2 volunteer health care provider program.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 135.24, subsection 1, Code 2005, is
1 2 amended to read as follows:
1 3 1. The director shall establish within the department a
1 4 program to provide to eligible hospitals, clinics, free
1 5 clinics, or other health care facilities, health care referral
1 6 programs, or charitable organizations, free medical, dental,
1 7 and chiropractic, pharmaceutical, psychological, social work,
1 8 behavioral science, podiatric, physical therapy, occupational
1 9 therapy, respiratory therapy, medical technology, and
1 10 emergency medical care services given on a voluntary basis by
1 11 health care providers. A participating health care provider
1 12 shall register with the department and obtain from the
1 13 department a list of eligible, participating hospitals,
1 14 clinics, free clinics, or other health care facilities, health
1 15 care referral programs, or charitable organizations.
1 16 Sec. 2. Section 135.24, subsection 2, paragraphs a, c, and
1 17 d, Code 2005, are amended to read as follows:
1 18 a. Procedures for registration of health care providers
1 19 deemed qualified by the board of medical examiners, the board
1 20 of physician assistant examiners, the board of dental
1 21 examiners, the board of nursing, the board of chiropractic
1 22 examiners, the board of psychology examiners, the board of
1 23 social work examiners, the board of behavioral science
1 24 examiners, and the board of pharmacy examiners, the board of
1 25 podiatry examiners, the board of physical and occupational
1 26 therapy examiners, the state board for respiratory care, and
1 27 the Iowa department of public health, as applicable.
1 28 c. Criteria for and identification of hospitals, clinics,
1 29 free clinics, or other health care facilities, health care
1 30 referral programs, or charitable organizations, eligible to
1 31 participate in the provision of free medical, dental, or
1 32 chiropractic, pharmaceutical, psychological, social work,
1 33 behavioral science, podiatric, physical therapy, occupational
1 34 therapy, respiratory therapy, medical technology, or emergency
1 35 medical care services through the volunteer health care
2 1 provider program. A free clinic, a health care facility, a
2 2 health care referral program, a charitable organization, or a
2 3 health care provider participating in the program shall not
2 4 bill or charge a patient for any health care provider service
2 5 provided under the volunteer health care provider program.
2 6 d. Identification of the services to be provided under the
2 7 program. The services provided may include, but shall not be
2 8 limited to, obstetrical and gynecological medical services,
2 9 psychiatric services provided by a physician licensed under
2 10 chapter 148, 150, or 150A, dental services or other services
2 11 provided under chapter 147A, 148A, 148B, 149, 151, 152B, 154B,
2 12 154C, 154D, or 155A.
2 13 Sec. 3. Section 135.24, subsection 3, paragraph b, Code
2 14 2005, is amended to read as follows:
2 15 b. Provided medical, dental, or chiropractic,
2 16 pharmaceutical, psychological, social work, behavioral
2 17 science, podiatric, physical therapy, occupational therapy,
2 18 respiratory therapy, medical technology, or emergency medical
2 19 care services through a hospital, clinic, free clinic, or
2 20 other health care facility, health care referral program, or
2 21 charitable organization listed as eligible and participating
2 22 by the department pursuant to subsection 1.
2 23 Sec. 4. Section 135.24, subsection 5, Code 2005, is
2 24 amended to read as follows:
2 25 5. For the purposes of this section, "charitable
2 26 organization" means a charitable organization within the
2 27 meaning of section 501(c)(3) of the Internal Revenue Code
2 28 which has as its primary purpose the sponsorship or support of
2 29 programs designed to improve the quality, awareness, and
2 30 availability of chiropractic, dental, or medical,
2 31 pharmaceutical, psychological, social work, behavioral
2 32 science, podiatric, physical therapy, occupational therapy,
2 33 respiratory therapy, medical technology, or emergency medical
2 34 care services to children and to serve as a funding mechanism
2 35 for provision of chiropractic, dental, or medical,
3 1 pharmaceutical, psychological, social work, behavioral
3 2 science, podiatric, physical therapy, occupational therapy,
3 3 respiratory therapy, medical technology, and emergency medical
3 4 care services, including but not limited to immunizations, to
3 5 children in this state.
3 6 Sec. 5. Section 135.24, subsection 6, paragraph b, Code
3 7 2005, is amended to read as follows:
3 8 b. "Health care provider" means a physician licensed under
3 9 chapter 148, 150, 150A, or 151, a physical therapist licensed
3 10 pursuant to chapter 148A, an occupational therapist licensed
3 11 pursuant to chapter 148B, a podiatrist licensed pursuant to
3 12 chapter 149, a physician assistant licensed and practicing
3 13 under a supervising physician pursuant to chapter 148C, a
3 14 licensed practical nurse, or a registered nurse licensed
3 15 pursuant to chapter 152, a respiratory therapist licensed
3 16 pursuant to chapter 152B, a dentist, dental hygienist, or
3 17 dental assistant registered or licensed to practice under
3 18 chapter 153, a psychologist licensed pursuant to chapter 154B,
3 19 a social worker licensed pursuant to chapter 154C, a mental
3 20 health counselor licensed pursuant to chapter 154D, or a
3 21 pharmacist licensed pursuant to chapter 155A, or a medical
3 22 technologist, emergency medical care provider, certified nurse
3 23 assistant, or certified medical assistant, certified or
3 24 approved by the Iowa department of public health.
3 25 EXPLANATION
3 26 This bill adds to the definition of "health care provider"
3 27 under the volunteer health care provider program, physical
3 28 therapists, occupational therapists, podiatrists, respiratory
3 29 therapists, medical technologists, emergency medical care
3 30 providers, certified nurse assistants, and certified medical
3 31 assistants. The bill also makes conforming changes to the
3 32 section of the Code establishing the volunteer health care
3 33 provider program to include physical therapists, occupational
3 34 therapists, podiatrists, medical technologists, emergency
3 35 medical care providers, certified nurse assistants, and
4 1 certified medical assistants.
