1 An Act requiring the department of education to conduct a study,
2 in consultation with the department of human services, of the
3 financial and educational relationship between school
4 districts and juvenile facilities.

1 1 Section 1. DEPARTMENT OF EDUCATION JUVENILE FACILITIES
1 2 FUNDING STUDY. The department of education, in consultation
1 3 with the department of human services, shall conduct a study
1 4 of the financial and educational relationship between school
1 5 districts and juvenile facilities administered or funded by
1 6 the department of human services. The study shall include,
1 7 but not be limited to, a review of the funding for educational
1 8 programs provided for children living in a psychiatric unit of
1 9 a hospital licensed under chapter 135B or a psychiatric
1 10 medical institution for children licensed under chapter 135H,
1 11 or in an approved or licensed shelter care home as defined in
1 12 section 232.2, subsection 34, or in an approved juvenile
1 13 detention home as defined in section 232.2, subsection 32, or
1 14 in a foster care facility licensed under chapter 237. The
1 15 recommendations developed shall include but not be limited to
1 16 the funding structure and source of funding. The department
1 17 shall submit a report of its findings and recommendations to
1 18 the chairpersons and ranking members of the joint
1 19 appropriations subcommittees on education and on health and
1 20 human services and the chairpersons and ranking members of the
1 21 standing committees on education by January 1, 2007.
1 22 EXPLANATION
1 23 This bill requires the department of education, in
1 24 consultation with the department of human services, to conduct
1 25 a study of the financial and educational relationship between
1 26 school districts and juvenile facilities administered by the
1 27 department of human services. The study shall include, but
1 28 not be limited to, a review of the funding for educational
1 29 programs provided for children living in a psychiatric unit of
1 30 a hospital licensed under Code chapter 135B, a psychiatric
1 31 medical institution for children licensed under Code chapter
1 32 135H, an approved or licensed shelter care home, an approved
1 33 juvenile detention home, or a foster care facility. The
1 34 recommendations developed shall include but not be limited to
1 35 the funding structure and source of funding. The department
