1 An Act relating to county, city, and school board publication of
2 allowed claims.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 28M.4, subsection 8, Code Supplement
1 2 2005, is amended to read as follows:
1 3 8. Immediately following a regular or special meeting of a
1 4 commission, the secretary of the commission shall prepare a
1 5 condensed statement of the proceedings of the commission and
1 6 cause the statement to be published not more than twenty days
1 7 following the meeting in one or more newspapers which meet the
1 8 requirements of section 618.14. The statement shall include a
1 9 list of all claims allowed, showing the name of the person or
1 10 firm making the claim, the reason for the claim, and the
1 11 amount of the claim. Two or more claims made by the same
1 12 vendor, supplier, or claimant may be consolidated if the
1 13 number of claims consolidated and the total consolidated claim
1 14 amount are listed in the statement. Salary claims must show
1 15 the gross amount of the claim except that salaries paid to
1 16 persons regularly employed by the commission, for services
1 17 regularly performed by the persons, shall be published once
1 18 annually showing the gross amount of the salary.
1 19 Sec. 2. Section 279.35, Code 2005, is amended to read as
1 20 follows:
1 21 279.35 PUBLICATION OF PROCEEDINGS.
1 22 The proceedings of each regular, adjourned, or special
1 23 meeting of the board, including the schedule of bills allowed,
1 24 shall be published after the adjournment of the meeting in the
1 25 manner provided in this section and section 279.36, and the
1 26 publication of the schedule of the bills allowed shall include
1 27 a list of claims allowed, including salary claims for services
1 28 performed. The schedule of bills allowed may be published on
1 29 a once monthly basis in lieu of publication with the
1 30 proceedings of each meeting of the board. The list of claims
1 31 allowed shall include the name of the person or firm making
1 32 the claim, the purpose of the claim, and the amount of the
1 33 claim. Two or more claims made by the same vendor, supplier,
1 34 or claimant may be consolidated if the number of claims
1 35 consolidated and the total consolidated claim amount are
2 1 listed in the statement. However, salaries paid to
2 2 individuals regularly employed by the district shall only be
2 3 published annually and the publication shall include the total
2 4 amount of the annual salary of each employee. The secretary
2 5 shall furnish a copy of the proceedings to be published within
2 6 two weeks following the adjournment of the meeting.
2 7 Sec. 3. Section 331.471, subsection 6, paragraph d, Code
2 8 2005, is amended to read as follows:
2 9 d. Immediately following a regular or special meeting of a
2 10 commission, the secretary of the commission shall prepare a
2 11 condensed statement of the proceedings of the commission and
2 12 cause the statement to be published as provided in section
2 13 331.305. The statement shall include a list of all claims
2 14 allowed, showing the name of the person or firm making the
2 15 claim, the reason for the claim, and the amount of the claim.
2 16 Two or more claims made by the same vendor, supplier, or
2 17 claimant may be consolidated if the number of claims
2 18 consolidated and the total consolidated claim amount are
2 19 listed in the statement. Salary claims must show the gross
2 20 amount of the claim except that salaries paid to persons
2 21 regularly employed by the commission, for services regularly
2 22 performed by the persons shall be published once annually
2 23 showing the gross amount of the salary. In counties having
2 24 more than one hundred fifty thousand population the commission
2 25 shall each month prepare in pamphlet form the statement
2 26 required in this paragraph for the preceding month, and
2 27 furnish copies to the public library, the daily and official
2 28 newspapers of the county, the auditor, and to persons who
2 29 apply at the office of the secretary, and the pamphlet shall
2 30 constitute publication as required. Failure by the secretary
2 31 to make publication is a simple misdemeanor.
2 32 Sec. 4. Section 349.18, Code 2005, is amended to read as
2 33 follows:

2 35 PUBLICATION.
3 1 1. All proceedings of each regular, adjourned, or special
3 2 meeting of a board of supervisors, including the schedule of
3 3 bills allowed, shall be published immediately after the
3 4 adjournment of the meeting, and the.
3 5 2. The publication of the schedule of the bills allowed
3 6 shall include a list of all claims allowed, including salary
3 7 claims for services performed, showing the name of the person
3 8 or firm making the claim and the amount of the claim, except
3 9 that the publication of claims shall comply with the
3 10 following:
3 11 a. The names of persons receiving relief shall not be
3 12 published. and salaries
3 13 b. The salaries paid to persons regularly employed by the
3 14 county shall only be published annually showing the total
3 15 amount of the annual salary.
3 16 c. Two or more claims made by the same vendor, supplier,
3 17 or claimant may be consolidated if the number of claims
3 18 consolidated and the total consolidated claim amount are
3 19 listed in the statement.
3 20 3. The county auditor shall furnish a copy of the
3 21 proceedings to be published, within one week following the
3 22 adjournment of the board.
3 23 Sec. 5. Section 372.13, subsection 6, Code 2005, is
3 24 amended to read as follows:
3 25 6. Within fifteen days following a regular or special
3 26 meeting of the council, the clerk shall cause the minutes of
3 27 the proceedings of the council, including the total
3 28 expenditure from each city fund, to be published in a
3 29 newspaper of general circulation in the city. The publication
3 30 shall include a list of all claims allowed and a summary of
3 31 all receipts and shall show the gross amount of the claim.
3 32 Two or more claims made by the same vendor, supplier, or
3 33 claimant may be consolidated if the number of claims
3 34 consolidated and the total consolidated claim amount are
3 35 listed in the statement. Matters discussed in closed session
4 1 pursuant to section 21.3 shall not be published until entered
4 2 on the public minutes. However, in cities having more than
4 3 one hundred fifty thousand population the council shall each
4 4 month print in pamphlet form a detailed itemized statement of
4 5 all receipts and disbursements of the city, and a summary of
4 6 its proceedings during the preceding month, and furnish copies
4 7 to the city library, the daily newspapers of the city, and to
4 8 persons who apply at the office of the city clerk, and the
4 9 pamphlet shall constitute publication as required. Failure by
4 10 the clerk to make publication is a simple misdemeanor. The
4 11 provisions of this subsection are applicable in cities in
4 12 which a newspaper is published, or in cities of two hundred
4 13 population or over, but in all other cities, posting the
4 14 statement in three public places in the city which have been
4 15 permanently designated by ordinance is sufficient compliance
4 16 with this subsection.
4 17 Sec. 6. Section 388.4, subsection 4, Code 2005, is amended
4 18 to read as follows:
4 19 4. Immediately following a regular or special meeting of a
4 20 utility board, the secretary shall prepare a condensed
4 21 statement of the proceedings of the board and cause the
4 22 statement to be published in a newspaper of general
4 23 circulation in the city. The statement must include a list of
4 24 all claims allowed, showing the name of the person or firm
4 25 making the claim, the reason for the claim, and the amount of
4 26 the claim. Two or more claims made by the same vendor,
4 27 supplier, or claimant may be consolidated if the number of
4 28 claims consolidated and the total consolidated claim amount
4 29 are listed in the statement. Salary claims must show the
4 30 gross amount of the claim except that salaries paid to persons
4 31 regularly employed by the utility, for services regularly
4 32 performed by them, must be published once annually showing the
4 33 gross amount of the salary. In cities having more than one
4 34 hundred fifty thousand population the utility board shall each
4 35 month prepare in pamphlet form the statement herein required
5 1 for the preceding month, and furnish copies to the city
5 2 library, the daily newspapers of the city, the city clerk, and
5 3 to persons who apply at the office of the secretary, and the
5 4 pamphlet shall constitute publication as required. Failure by
5 5 the secretary to make publication is a simple misdemeanor.
5 6 EXPLANATION
5 7 This bill changes how a city or county, including a
5 8 regional transit district commission, county enterprise
5 9 commission, or city utility board, publishes a list of allowed
5 10 claims. Similarly, the bill changes how a school board
5 11 publishes a list of allowed claims. Two or more claims made
5 12 by the same vendor, supplier, or claimant may be consolidated
5 13 if the number of claims consolidated and the total
5 14 consolidated claim amount are listed in the statement.
