  1  1    Section 1.  NEW SECTION.  237A.31  SEX OFFENDER ==
  1  2 RESTRICTED PRESENCE.
  1  3    A person required to register as a sex offender under
  1  4 chapter 692A shall not be present at a child care facility or
  1  5 child care home unless the person is a parent or guardian of a
  1  6 child being supervised at the facility or home, and is in the
  1  7 process of directly attending to the child's needs while at
  1  8 the facility or home, or is in the process of dropping off or
  1  9 picking up the child.  A person who violates this section
  1 10 commits a serious misdemeanor.
  1 11                           EXPLANATION
  1 12    This bill restricts the presence of a registered sex
  1 13 offender at a child care facility or child care home.
  1 14    The bill provides that a person required to register as a
  1 15 sex offender shall not be present at a licensed or registered
  1 16 child care facility or unregistered child care home unless the
  1 17 person is a parent or guardian of a child being supervised at
  1 18 the facility or home, and is in the process of attending to
  1 19 the child's needs while at the facility or home, or is in the
  1 20 process of dropping off or picking up the child.
  1 21    A "child care facility" means a child care center,
  1 22 preschool, or registered child development home.  A "child
  1 23 care home" means a person or program providing child care to
  1 24 five or fewer children at any one time that is not registered
  1 25 to provide child care under Code chapter 237A.
  1 26    A person who violates the bill commits a serious
  1 27 misdemeanor.
  1 28    A serious misdemeanor is punishable by confinement for no
  1 29 more than one year and a fine of at least $250 but not more
  1 30 than $1,500.
