1 An Act relating to the legal name change of a person required to
2 register as a sex offender.

1 1 Section 1. Section 674.1, Code 2005, is amended to read as
1 2 follows:
1 3 674.1 AUTHORIZATION.
1 4 A Except as otherwise provided in section 692A.2B, a person
1 5 who has attained the age of majority and who does not have any
1 6 civil disabilities may apply to the court to change the
1 7 person's name by filing a verified petition as provided in
1 8 this chapter. The verified petition may request a name change
1 9 for minor children of the petitioner as well as the petitioner
1 10 or a parent may file a verified petition requesting a name
1 11 change on behalf of a minor child of the parent.
1 12 Sec. 2. NEW SECTION. 692A.2B LEGAL NAME CHANGE.
1 13 Notwithstanding the provisions of chapter 674, a person
1 14 required to register under this chapter shall not legally
1 15 change the person's name unless the person's name change is
1 16 the result of marriage or dissolution of marriage.
1 17 Sec. 3. Section 692A.3, subsection 2, Code 2005, is
1 18 amended to read as follows:
1 19 2. A person required to register under this chapter shall,
1 20 within five days of changing residence within a county in this
1 21 state or within five days of a change in the person's name as
1 22 a result of marriage, or dissolution of marriage, or a legal
1 23 name change, notify the sheriff of the county in which the
1 24 person is registered of the change of address, name, and any
1 25 changes in the person's telephone number in writing on a form
1 26 provided by the sheriff. The sheriff shall send a copy of the
1 27 change of information to the department within three working
1 28 days of receipt of notice of the change. The sex offender
1 29 registry shall maintain and make available information from
1 30 the registry cross=referenced by name at the time of
1 31 conviction and by name subsequent to any change.
1 32 Sec. 4. Section 692A.9, Code 2005, is amended to read as
1 33 follows:
1 34 692A.9 REGISTRATION FORMS.
1 35 Registration forms shall be prepared by the department and
2 1 shall include the registrant's name at the time of conviction
2 2 and any change of name as a result of marriage, or dissolution
2 3 of marriage, or legal name change, the registrant's social
2 4 security number, date of birth, the registrant's current
2 5 address, and, if applicable, the registrant's telephone
2 6 number. The forms may provide for the reporting of additional
2 7 relevant information such as, but not limited to, fingerprints
2 8 and photographs but shall not include information identifying
2 9 the victim of the crime of which the registrant was convicted.
2 10 Additional information for persons required to register as a
2 11 sexually violent predator shall include, but not be limited
2 12 to, other identifying factors, anticipated future places of
2 13 residence, offense history, and documentation of any treatment
2 14 received by the person for mental abnormality or personality
2 15 disorder. Copies of blank forms shall be available upon
2 16 request to any person from the sheriff.
2 17 EXPLANATION
2 18 This bill relates to the legal name change of a person
2 19 required to register as a sex offender. The bill prohibits a
2 20 person required to register as a sex offender from legally
2 21 changing the person's name unless the person's name change is
2 22 the result of marriage or dissolution of marriage.
