1 An Act prohibiting amusement devices and monitor vending machines
2 in counties that have defeated a proposal to authorize
3 gambling games on excursion gambling boats or pari=mutuel
4 racetracks in that county.

1 1 Section 1. Section 99B.10, Code Supplement 2005, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 10. An electrical or mechanical amusement
1 4 device required to be registered as provided by this section
1 5 shall not be located in any county in which the result of the
1 6 most recent referendum conducted in that county pursuant to
1 7 section 99F.7 was a defeat of a proposal to conduct gambling
1 8 games on excursion gambling boats or the defeat of a proposal
1 9 to conduct gambling games at a licensed pari=mutuel racetrack
1 10 enclosure.
1 11 Sec. 2. NEW SECTION. 99G.30A MONITOR VENDING MACHINES ==
1 12 PROHIBITED AREAS.
1 13 1. A monitor vending machine shall not be located in any
1 14 county in which the result of the most recent referendum
1 15 conducted in that county pursuant to section 99F.7 was a
1 16 defeat of a proposal to conduct gambling games on excursion
1 17 gambling boats or the defeat of a proposal to conduct gambling
1 18 games at a licensed pari=mutuel racetrack enclosure.
1 19 2. For purposes of this section, a "monitor vending
1 20 machine" means a machine or other similar electronic device
1 21 that includes a video monitor and audio capabilities that
1 22 dispenses to a purchaser lottery tickets that have been
1 23 determined to be winning or losing tickets by a predetermined
1 24 pool drawing machine prior to the dispensing of the tickets.
1 25 EXPLANATION
1 26 This bill prohibits locating an electrical or mechanical
1 27 amusement device that is required to be registered or a
1 28 monitor vending machine of the Iowa lottery in any county that
1 29 has rejected a proposal to authorize gambling games on
1 30 excursion gambling boats or pari=mutuel racetracks. The bill
1 31 provides that the prohibition would not apply if the county
1 32 subsequently passes a referendum authorizing gambling games in
1 33 that county. The bill also defines a "monitor vending
1 34 machine" as a machine with a video monitor and audio
1 35 capabilities that dispenses to a purchaser lottery tickets
2 1 that have been determined to be winning or losing tickets by a
2 2 predetermined pool drawing machine prior to the dispensing of
2 3 the tickets.
