1 An Act relating to county distress criteria and certification
2 limits under the enterprise zone program and including an
3 effective date provision.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 15E.192, subsection 3, paragraph b,
1 2 Code Supplement 2005, is amended to read as follows:
1 3 b. A county or city may apply to the department for an
1 4 area to be certified as an enterprise zone at any time prior
1 5 to March 1, 2006 July 1, 2008. However, the total amount of
1 6 land designated as enterprise zones under subsections 1 and 2,
1 7 and any other enterprise zones certified by the department,
1 8 excluding those approved pursuant to section 15E.194,
1 9 subsection 4, shall not exceed in the aggregate one percent of
1 10 the total county area.
1 11 Sec. 2. Section 15E.194, subsection 1, Code 2005, is
1 12 amended by adding the following new paragraphs:
1 13 NEW PARAGRAPH. e. The county has a per capita income of
1 14 eighty percent or less of the national average per capita
1 15 income.
1 16 NEW PARAGRAPH. f. The county has a household median
1 17 income of eighty percent or less of the national average
1 18 household median income.
1 19 NEW PARAGRAPH. g. Twenty=five percent or more of the
1 20 population in the county has an income level of one hundred
1 21 fifty percent or less of the United States poverty level as
1 22 defined by the most recently revised poverty income guidelines
1 23 published by the United States department of health and human
1 24 services.
1 25 NEW PARAGRAPH. h. The county has a population density of
1 26 less than ten people per square mile.
1 27 NEW PARAGRAPH. i. The county has a loss of population as
1 28 shown by the 2000 certified federal census when compared with
1 29 the 1990 certified federal census.
1 30 NEW PARAGRAPH. j. The county has an unemployment rate
1 31 greater than the national rate of unemployment.
1 32 NEW PARAGRAPH. k. More than twenty percent of the
1 33 population of the county consists of persons over the age of
1 34 sixty=five.
1 35 Sec. 3. IMMEDIATE EFFECTIVE DATE. This Act, being deemed
2 1 of immediate importance, takes effect upon enactment.
2 2 EXPLANATION
2 3 This bill relates to county distress criteria and
2 4 certification limits under the enterprise zone program.
2 5 Currently, under the enterprise zone program, a county or
2 6 city may apply to the department of economic development for
2 7 an area to be certified as an enterprise zone at any time
2 8 prior to March 1, 2006. The bill changes the date to July 1,
2 9 2008.
2 10 Currently, in order for an enterprise zone to be designated
2 11 by a county, two of four distress criteria must be met. The
2 12 bill adds seven possible distress criteria to the list.
2 13 This Act takes effect upon enactment.
