1 1 Section 1. Section 15E.192, subsection 3, Code Supplement
1 2 2005, is amended to read as follows:
1 3 3. a. (1) An enterprise zone certified by the department
1 4 pursuant to subsection 2 shall only be amended if the
1 5 amendment consists of an area being added to the enterprise
1 6 zone and the added area meets the criteria of section 15E.194,
1 7 subsection 2. An enterprise zone certified by the department
1 8 pursuant to subsection 1 or 2 may be decertified; however, if
1 9 a subsequent enterprise zone is designated, the expiration
1 10 date of the subsequent enterprise zone shall be the same as
1 11 the expiration date of the decertified enterprise zone. A
1 12 portion of a certified enterprise zone may be decertified,
1 13 provided that the remaining portion of the certified
1 14 enterprise zone meets the distress criteria provided in
1 15 section 15E.194.
1 16 (2) A city or county that is not eligible to designate an
1 17 enterprise zone but previously designated enterprise zones
1 18 pursuant to section 15E.194, Code 1997, which were equivalent
1 19 in area to one percent of the total county area may decertify
1 20 all or a portion of an enterprise zone and designate a
1 21 subsequent enterprise zone if all of the following criteria
1 22 are met:
1 23 (a) A subsequent enterprise zone of equivalent area or
1 24 less is designated.
1 25 (b) The subsequent enterprise zone meets the same distress
1 26 criteria as were applicable to the decertified enterprise
1 27 zone.
1 28 (c) The expiration date of the subsequent enterprise zone
1 29 is the same as the expiration date of the decertified
1 30 enterprise zone.
1 31 b. A county or city may apply to the department for an
1 32 area to be certified as an enterprise zone at any time prior
1 33 to March 1, 2006 2008. However, the total amount of land
1 34 designated as enterprise zones under subsections 1 and 2, and
1 35 any other enterprise zones certified by the department,
2 1 excluding those approved pursuant to section 15E.194,
2 2 subsection 4, shall not exceed in the aggregate one percent of
2 3 the total county area.
2 4 EXPLANATION
2 5 This bill relates to enterprise zone certification.
2 6 The bill allows a city or county that is not eligible to
2 7 designate an enterprise zone but previously designated
2 8 enterprise zones pursuant to section 15E.194, Code 1997, which
2 9 were equivalent in area to 1 percent of the total county area,
2 10 to decertify all or a portion of an enterprise zone and
2 11 designate a subsequent enterprise zone provided certain
2 12 criteria are met. The criteria include that a subsequent
2 13 enterprise zone of equivalent size or less must be designated,
2 14 that the subsequent enterprise zone must meet the same
2 15 distress criteria as were applicable to the decertified
2 16 enterprise zone, and that the expiration date of the
2 17 subsequent enterprise zone must be the same as the expiration
2 18 date of the decertified enterprise zone.
2 19 Currently, an area must be certified as an enterprise zone
2 20 prior to March 1, 2006. The bill extends this date to March
2 21 1, 2008.
