1 An Act relating to the senior living trust fund and providing for
2 appropriation of the moneys in the fund.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 249H.2, subsection 1, paragraph f, Code
1 2 2005, is amended to read as follows:
1 3 f. Grants are necessary to cover the expenditures related
1 4 to the development of alternative health care services.
1 5 Development of these long=term care alternatives will improve
1 6 access to and delivery of long=term care services to
1 7 underserved individuals or in underserved areas, which will in
1 8 turn contain or reduce the cost and improve the quality of
1 9 health care services.
1 10 Sec. 2. Section 249H.3, subsections 3, 6, and 8, Code
1 11 2005, are amended by striking the subsections.
1 12 Sec. 3. Section 249H.5, subsection 1, Code 2005, is
1 13 amended to read as follows:
1 14 1. Moneys deposited in the senior living trust fund
1 15 created in section 249H.4 shall be used only as provided in
1 16 appropriations from the trust fund to the department of human
1 17 services and the department of elder affairs, and for
1 18 purposes, including the awarding of grants, as specified in
1 19 this chapter.
1 20 Sec. 4. Section 249H.5, subsection 2, Code 2005, is
1 21 amended by striking the subsection and inserting in lieu
1 22 thereof the following:
1 23 2. Moneys in the trust fund are allocated, subject to
1 24 their appropriation by the general assembly, to the department
1 25 of elder affairs, in an amount necessary, annually, for
1 26 expenses incurred in implementation and administration of the
1 27 long=term care alternatives programs and for delivery of
1 28 long=term care services to seniors with low or moderate
1 29 incomes.
1 30 Sec. 5. Section 249H.5, subsection 3, Code 2005, is
1 31 amended to read as follows:
1 32 3. a. Any funds remaining after disbursement of moneys
1 33 under subsection 2 shall be invested with the interest earned
1 34 to be available in subsequent fiscal years for the purposes
1 35 provided in subsection 2, paragraph "b", and subsection 2,
2 1 paragraph "c", subparagraphs (1) and (2).
2 2 b. Moneys in the fund shall not be appropriated in an
2 3 amount in excess of the amount appropriated for the purposes
2 4 specified in subsection 2, or for purposes other than those
2 5 specified in subsection 2, until such time as the amount
2 6 deposited in the fund, following disbursement of moneys under
2 7 subsection 2, exceeds two hundred million dollars. At such
2 8 time, moneys in the fund may be appropriated in an amount that
2 9 does not reduce the fund balance below two hundred million
2 10 dollars and only for the purpose of providing additional
2 11 funding for the purposes of subsection 2.
2 12 Sec. 6. Section 249H.11, Code 2005, is amended to read as
2 13 follows:
2 14 249H.11 FUTURE REPEAL GRANTS.
2 15 Section 249H.6 is repealed on June 30, 2005. However,
2 16 Nursing facility conversion and long=term care services
2 17 development grants awarded pursuant to section 249H.6, Code
2 18 2005, and moneys appropriated for such grants on or before
2 19 June 30, 2005, shall be disbursed to eligible applicants after
2 20 that date if necessary.
2 21 EXPLANATION
2 22 This bill provides for the use of moneys in the senior
2 23 living trust fund. The bill limits the purposes for which the
2 24 moneys in the fund may be appropriated to the implementation
2 25 and administration of the long=term care alternatives programs
2 26 and the delivery of long=term care services to seniors with
2 27 low or moderate incomes.
2 28 The bill also provides that moneys in the fund are not to
2 29 be appropriated in an amount in excess of the amounts
2 30 specified for the purpose specified, or for purposes other
2 31 than those specified, until such time as the amount deposited
2 32 in the fund, following disbursement of moneys for the two
2 33 purposes and in the amounts specified, exceeds $200 million.
2 34 At such time as the amount exceeds $200 million, moneys in the
2 35 fund may be appropriated in an amount that does not reduce the
3 1 fund balance below $200 million and only for the purposes of
3 2 providing additional funding for implementation and
3 3 administration of the long=term care alternatives programs and
3 4 for delivery of long=term care services to seniors with low or
3 5 moderate incomes.
3 6 The bill also makes a conforming change due to the repeal
3 7 of the Code section related to nursing facility conversion and
3 8 long=term care services development grants.
