  1  1    Section 1.  Section 306C.10, subsection 4, paragraph a,
  1  2 Code 2005, is amended to read as follows:
  1  3    a.  Outdoor advertising structures, except as provided in
  1  4 section 306C.11, subsection 3, paragraph "c".
  1  5    Sec. 2.  Section 306C.11, subsection 3, Code 2005, is
  1  6 amended by adding the following new paragraph:
  1  7    NEW PARAGRAPH.  c.  The department shall permit a billboard
  1  8 or other outdoor advertising structure to be erected or
  1  9 maintained on property not currently used for commercial or
  1 10 industrial activities at the request of the landowner and the
  1 11 county board of supervisors and city council having
  1 12 jurisdiction over the property, provided the property is zoned
  1 13 for commercial and industrial use prior to installation of the
  1 14 billboard or advertising structure.
  1 15                           EXPLANATION
  1 16    This bill amends the billboard control law to require the
  1 17 state department of transportation to allow a landowner to
  1 18 erect a billboard or other outdoor advertising structure along
  1 19 a primary highway on property that is not otherwise used for
  1 20 commercial or industrial activities, at the joint request of
  1 21 the landowner and city and county authorities.  The property
  1 22 must be zoned for commercial or industrial use before the
  1 23 billboard or advertising structure is installed.  Under
  1 24 current law, an advertising device is not permitted on
  1 25 property that is zoned commercial or industrial for the sole
  1 26 purpose of allowing outdoor advertising.
