1 An Act establishing the racing and gaming commission as the board
2 of directors for the Iowa lottery authority.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 99D.5, Code Supplement 2005, is amended
1 2 by adding the following new subsection:
1 3 NEW SUBSECTION. 7. A member of the commission shall
1 4 comply with requirements made applicable to members pursuant
1 5 to Code chapter 99G.
1 6 Sec. 2. Section 99G.8, Code 2005, is amended by striking
1 7 the section and inserting in lieu thereof the following:
1 8 99G.8 BOARD OF DIRECTORS.
1 9 1. The authority shall be administered by a board of
1 10 directors which shall be the state racing and gaming
1 11 commission created under section 99D.5.
1 12 2. Board members shall not have any direct or indirect
1 13 interest in an undertaking that puts their personal interest
1 14 in conflict with that of the authority, including but not
1 15 limited to an interest in a major procurement contract or a
1 16 participating retailer.
1 17 3. The board of directors may delegate to the chief
1 18 executive officer of the authority such powers and duties as
1 19 it may deem proper to the extent such delegation is not
1 20 inconsistent with the Constitution of this state.
1 21 EXPLANATION
1 22 This bill provides that the racing and gaming commission
1 23 shall be the board of directors of the Iowa lottery authority.
1 24 Under current law, a separate Iowa lottery authority board of
1 25 directors exists and that board is eliminated by the bill.
1 26 The current duties and requirements of the Iowa lottery
1 27 authority board are made the responsibility of the racing and
1 28 gaming commission by the bill.
