  1  1    Section 1.  Section 455B.173, subsection 3, unnumbered
  1  2 paragraph 3, Code 2005, is amended to read as follows:
  1  3    A publicly owned treatment works whose discharge meets the
  1  4 final effluent limitations which were contained in its
  1  5 discharge permit on the date that construction of the publicly
  1  6 owned treatment works was approved by the department shall not
  1  7 be required to meet more stringent effluent limitations for a
  1  8 period of ten years from the date the construction was
  1  9 completed and accepted but not longer than twelve years from
  1 10 the date that construction was approved by the department.  In
  1 11 addition, such publicly owned treatment works shall not be
  1 12 required to build additional treatment facilities for a period
  1 13 of twenty years from the date the construction was completed.
  1 14                           EXPLANATION
  1 15    This bill relates to construction requirements for publicly
  1 16 owned water treatment works.
  1 17    The bill provides that a publicly owned water treatment
  1 18 works whose discharge meets the final effluent limitations
  1 19 which were contained in its discharge permit on the date that
  1 20 construction of the publicly owned treatment works was
  1 21 approved by the department shall not be required to build
  1 22 additional treatment facilities for a period of 20 years from
  1 23 the date the construction was completed.
