Section 152C.7A, Code 2005, is amended to read 1 2 as follows: 1 3 152C.7A TEMPORARY EXEMPTIONS. 1 4 1. An individual who is engaged exclusively in the 1 5 practice of reflexology or an unlicensed individual who is 1 6 practicing a modality related to massage therapy, and whose 1 7 professional practice does not incorporate aspects that 1 8 constitute massage therapy as defined in section 152C.1, shall 1 9 not be subject to the licensure provisions of this chapter for 1 10 a one=year period beginning July 1, 2003, and ending June 30, 1 11 2004. Beginning July 1, 2004, an individual who is engaged 1 12 exclusively in the practice of reflexology or an unlicensed 1 13 individual who is practicing a modality related to massage 1 14 therapy shall be subject to licensure pursuant to this chapter 1 15 unless, based upon the recommendations contained in the 1 16 massage therapy modalities study as provided in section 1 17 152C.5A, the practice of reflexology or an unlicensed 1 18 individual who is practicing a modality related to massage 1 19 therapy is permanently exempted from massage therapy 1 20 licensure. 1 21 2. Persons who have successfully completed a program 1 22 recognized by the board, who provide verification to the board 1 23 of the submission of an application and fee to the national 1 24 certification board for massage therapy in preparation for 1 25 taking the next regularly scheduled national certification 1 26 examination, and who are working under the supervision of a 1 27 person licensed pursuant to this chapter, shall not be subject 1 28 to the licensure provisions of this chapter pending the 1 29 receipt of the results of the examination. If the person does 1 30 not successfully pass the national certification examination, 1 31 this exemption shall not apply and continued practice shall be 1 32 subject to the penalty provisions of section 152C.4. 1 33 Sec. 2. Section 152C.9, subsections 2 and 3, Code 2005, 1 34 are amended to read as follows: 1 35 2. Persons who are licensed, registered, or certified in 2 1 another state, territory, the District of Columbia, or a 2 2 foreign country when incidentally present in this state to 2 3 teach a course of instruction related to massage and bodywork 2 4 therapy or to consult with a person licensedunder subtitle 3 2 5 of this titlepursuant to this chapter. 2 6 3. Students enrolled in a program recognized by the board 2 7 while completing a clinical requirement for graduation 2 8 performed under the supervision of a person licensedunder 2 9 subtitle 3 of this titlepursuant to this chapter. 2 10 EXPLANATION 2 11 This bill provides that an applicant for licensure as a 2 12 massage therapist, having successfully completed a program 2 13 recognized by the board of massage therapy examiners, can 2 14 practice massage therapy under the supervision of a licensed 2 15 massage therapist pending receipt of the results of their 2 16 licensure examination. 2 17 The bill provides that to qualify for this exemption from 2 18 licensure, the applicant must verify the submission of an 2 19 application and fee to the national certification board for 2 20 massage therapy in preparation for taking the next regularly 2 21 scheduled national certification examination. In the event 2 22 the examination is not passed, the bill provides that 2 23 continued practice shall be subject to the penalty provisions 2 24 of Code section 152C.4. 2 25 The bill makes technical changes to two other exemption 2 26 provisions, clarifying references to the chapter's licensing 2 27 requirements. 2 28 LSB 5317HH 81 2 29 rn:rj/cf/24
