1 1 Section 1. Section 455G.23, subsection 2, paragraph a,
1 2 Code 2005, is amended to read as follows:
1 3 a. By January February 1, 2004 2005, the aboveground
1 4 petroleum storage tank site was registered with the state fire
1 5 marshal pursuant to section 101.22.
1 6 Sec. 2. EFFECTIVE DATE AND RETROACTIVE APPLICABILITY.
1 7 This Act, being deemed of immediate importance, takes effect
1 8 upon enactment and applies retroactively to January 1, 2004.
1 9 EXPLANATION
1 10 This bill relates to criteria for reimbursement of owners
1 11 of aboveground petroleum storage tank sites.
1 12 Currently, the Iowa comprehensive petroleum underground
1 13 storage tank fund board may reimburse the owner of an
1 14 aboveground petroleum storage tank site up to $25,000 per
1 15 site, but not more than a total of $100,000 per owner, for the
1 16 upgrade or permanent closure of the aboveground petroleum
1 17 storage tank site provided certain criteria are met. One of
1 18 the criteria is that, by January 1, 2004, the aboveground
1 19 petroleum storage tank site was registered with the state fire
1 20 marshal. The bill changes the January 1, 2004, date to
1 21 February 1, 2005.
1 22 The bill takes effect upon enactment and applies
1 23 retroactively to January 1, 2004.
