1 An Act increasing the number of years for which supplementary
2 weighting for limited English proficient students may be
3 obtained, and providing an effective and applicability date.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 257.31, subsection 5, paragraph j, Code
1 2 2005, is amended to read as follows:
1 3 j. Unusual need to continue providing a program or other
1 4 special assistance to non=English speaking pupils after the
1 5 expiration of the three=year five=year period specified in
1 6 section 280.4.
1 7 Sec. 2. Section 280.4, subsection 3, Code 2005, is amended
1 8 to read as follows:
1 9 3. In order to provide funds for the excess costs of
1 10 instruction of limited English proficient students above the
1 11 costs of instruction of pupils in a regular curriculum,
1 12 students identified as limited English proficient shall be
1 13 assigned an additional weighting of twenty=two hundredths, and
1 14 that weighting shall be included in the weighted enrollment of
1 15 the school district of residence for a period not exceeding
1 16 three five years. However, the school budget review committee
1 17 may grant supplemental aid or modified allowable growth to a
1 18 school district to continue funding a program for students
1 19 after the expiration of the three=year five=year period.
1 20 Sec. 3. EFFECTIVE AND APPLICABILITY DATE. This Act, being
1 21 deemed of immediate importance, takes effect upon enactment
1 22 and is applicable for the school budget year beginning July 1,
1 23 2006, and succeeding budget years.
1 24 EXPLANATION
1 25 This bill extends the period of time for which a school
1 26 district may receive supplementary weighting for limited
1 27 English proficient students from the current period of three
1 28 years to five years. The bill makes a corresponding change to
1 29 a provision that the school budget review committee may grant
1 30 supplemental aid or modified allowable growth to a district
1 31 after expiration of the supplementary weighting time frame.
1 32 The bill takes effect upon enactment, and is applicable for
1 33 the school budget year beginning July 1, 2006, and succeeding
1 34 budget years.
