1 An Act relating to water quality protection standards and
2 providing an effective date.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 455B.173, Code 2005, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 13. Adopt rules specifying water quality
1 4 protection standards for all waters of the state consistent
1 5 with the federal Clean Water Act, 33 U.S.C. } 1251 et seq.
1 6 The standards shall provide water quality for the protection
1 7 and propagation of fish, shellfish, and wildlife, and for
1 8 recreation in and on the waters of this state and take into
1 9 consideration the use of such waters and value of public water
1 10 supplies, propagation of fish, shellfish, and wildlife,
1 11 recreation in and on the waters of this state, and
1 12 agricultural, industrial, and other purposes including
1 13 navigation. Rules adopted pursuant to this subsection shall
1 14 only apply to discharges occurring after the effective date of
1 15 such rules and discharges that increase after the effective
1 16 date of such rules.
1 17 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 18 immediate importance, takes effect upon enactment.
1 19 EXPLANATION
1 20 This bill relates to water quality protection standards.
1 21 The bill requires the environmental protection commission to
1 22 adopt rules specifying water quality protection standards for
1 23 all waters of the state consistent with the federal Clean
1 24 Water Act. The bill provides that the standards shall provide
1 25 water quality for the protection and propagation of fish,
1 26 shellfish, and wildlife, and for recreation in and on the
1 27 waters of this state and take into consideration the use of
1 28 such waters and value of public water supplies, propagation of
1 29 fish, shellfish, and wildlife, recreation in and on the waters
1 30 of this state, and agricultural, industrial, and other
1 31 purposes including navigation. The bill provides that rules
1 32 adopted pursuant to the new provision shall only apply to
1 33 discharges occurring after the effective date of the rules and
1 34 discharges that increase after the effective date of the
1 35 rules.
2 1 The bill takes effect upon enactment.
