1 An Act relating to residency qualifications for purposes of
2 postsecondary tuition and fees paid at public institutions of
3 higher education in this state.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 260C.14, Code 2005, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 21. Adopt a policy, to take effect not
1 4 later than January 1, 2006, related to the classification of
1 5 students for purposes of determining tuition and fees that
1 6 provides equal opportunity for granting resident status to
1 7 individuals who meet all of the following conditions:
1 8 a. Resided in this state for at least three years as of
1 9 the date the individual graduated from an accredited high
1 10 school or received a high school equivalency diploma in this
1 11 state.
1 12 b. Is accepted for enrollment in a community college in
1 13 this state.
1 14 c. Is an undocumented person who is not a citizen or
1 15 national of the United States.
1 16 d. Has established domicile in Iowa for the period during
1 17 which the individual is enrolled at the community college.
1 18 Sec. 2. Section 262.9, Code 2005, is amended by adding the
1 19 following new subsection:
1 20 NEW SUBSECTION. 31. Adopt a policy, to take effect not
1 21 later than January 1, 2006, related to the classification of
1 22 students for purposes of determining tuition and fees that
1 23 provides equal opportunity for granting resident status to
1 24 individuals who meet all of the following conditions:
1 25 a. Resided in this state for at least three years as of
1 26 the date the individual graduated from an accredited high
1 27 school or received a high school equivalency diploma in this
1 28 state.
1 29 b. Is accepted for enrollment in a university under the
1 30 control of the board in this state.
1 31 c. Is an undocumented person who is not a citizen or
1 32 national of the United States.
1 33 d. Has established domicile in Iowa for the period during
1 34 which the individual is enrolled at a university under the
1 35 control of the board.
2 1 EXPLANATION
2 2 This bill directs the board of directors of a community
2 3 college and the state board of regents to adopt policies
2 4 related to the classification of noncitizen students for
2 5 purposes of determining tuition and fees. The policies must
2 6 provide equal opportunity for granting resident status for
2 7 tuition and fee purposes to an individual who resided in this
2 8 state at least three years prior to graduating or receiving a
2 9 high school equivalency diploma in this state, is accepted for
2 10 enrollment in a postsecondary institution in this state, is an
2 11 undocumented person who is not a citizen or a national of the
2 12 United States, and has established domicile in Iowa for the
2 13 period in which the person is enrolled at the postsecondary
2 14 institution.
