Section 707.5, Code 2005, is amended to read as 1 2 follows: 1 3 707.5 INVOLUNTARY MANSLAUGHTER. 1 4 1. A person commits a class "C" felony when the person 1 5 unintentionally causes the death of another person under 1 6 circumstances manifesting an extreme indifference to the value 1 7 of human life. 1 81.2. A person commits a class "D" felony when the person 1 9 unintentionally causes the death of another person by the 1 10 commission of a public offense other than a forcible felony or 1 11 escape. 1 122.3. A person commits an aggravated misdemeanor when the 1 13 person unintentionally causes the death of another person by 1 14 the commission of an act in a manner likely to cause death or 1 15 serious injury. 1 16 Involuntary manslaughter as defined in this section is an 1 17 included offense under an indictment for murder in the first 1 18 or second degree or voluntary manslaughter. 1 19 EXPLANATION 1 20 This bill expands the definition of the criminal offense of 1 21 involuntary manslaughter. 1 22 A person commits a class "C" felony under the bill if the 1 23 person unintentionally causes the death of another by the 1 24 commission of an act that manifests an extreme indifference to 1 25 the value of human life. 1 26 A class "C" felony is punishable by confinement for no more 1 27 than 10 years and a fine of at least $1,000 but not more than 1 28 $10,000. 1 29 LSB 1422YH 81 1 30 jm/pj/5
