House Concurrent Resolution 10 - Introduced PAG LIN 1 1 HOUSE CONCURRENT RESOLUTION NO. 1 2 BY COMMITTEE ON JUDICIARY 1 3 (SUCCESSOR TO HSB 248) 1 4 A Concurrent Resolution requesting the establishment 1 5 of an interim study committee by the legislative 1 6 council to conduct a study of issues related to the 1 7 costs of professional liability insurance for health 1 8 care providers in Iowa. 1 9 WHEREAS, medical liability insurance covers health 1 10 care providers and health care facilities for 1 11 liability claims arising from the examination, care, 1 12 and treatment of health care patients; and 1 13 WHEREAS, the cost of medical liability insurance 1 14 has increased, limiting access to quality health care 1 15 in Iowa; NOW THEREFORE, 1 16 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE 1 17 SENATE CONCURRING, That the legislative council is 1 18 requested to establish a medical liability insurance 1 19 interim committee. The purpose of the interim 1 20 committee shall be to provide regulatory agencies and 1 21 the general assembly with possible solutions to 1 22 alleviate problems regarding the availability and 1 23 affordability of medical liability insurance in Iowa. 1 24 The interim committee may consider, but not be limited 1 25 to considering, a broad range of factors affecting the 1 26 availability and affordability of medical liability 1 27 insurance in Iowa, including the number of medical 1 28 malpractice incidents filed over the past five years, 1 29 the premium amounts charged by medical liability 1 30 insurers, the type of damages awarded in medical 2 1 liability actions, insurance regulatory requirements, 2 2 and applicable state and federal law. 2 3 BE IT FURTHER RESOLVED, That the legislative 2 4 council shall select the members of the committee, 2 5 which shall include three members of the house of 2 6 representatives appointed by the speaker of the house, 2 7 three members from the senate appointed by the co= 2 8 presidents of the senate, all of whom shall be voting 2 9 members, representatives of medical liability 2 10 insurers, health care professionals and health care 2 11 facilities that purchase medical liability insurance, 2 12 attorneys that represent plaintiffs in medical 2 13 liability actions, attorneys that represent defendants 2 14 in medical liability actions, and any other parties or 2 15 experts as deemed appropriate by the legislative 2 16 council, all of whom shall be nonvoting members; and 2 17 BE IT FURTHER RESOLVED, That the interim committee 2 18 shall submit a report to the general assembly on or 2 19 before January 15, 2006, regarding the committee's 2 20 findings and recommended solutions, including proposed 2 21 legislation, to make medical liability insurance more 2 22 available and more affordable in Iowa. 2 23 LSB 3030HV 81 2 24 rh:rj/sh/8 1
