2 nonpublic schools, making appropriations, and providing
3 effective and applicability dates.

1 1 Section 1. NEW SECTION. 257.8A NONPUBLIC SCHOOL STATE
1 2 AID == ANNUAL INCREASE.
1 3 1. For the school budget year beginning July 1, 2004, and
1 4 succeeding budget years, the amount appropriated for the base
1 5 year to school districts pursuant to sections 285.2 and 285.3
1 6 for nonpublic school transportation costs, pursuant to section
1 7 301.1 for nonpublic school textbooks, and, to the extent
1 8 appropriated for the base year, for nonpublic school
1 9 technology assistance, shall be increased by an amount
1 10 corresponding to the state percent of growth established for
1 11 that budget year pursuant to section 257.8. Any subsequent
1 12 adjustment or modification to the state percent of growth
1 13 resulting in the establishment of a different level than that
1 14 originally established for a budget year shall be applicable
1 15 to the annual increase pursuant to this section. The annual
1 16 increase shall be considered miscellaneous income to the
1 17 school district.
1 18 Sec. 2. Section 285.2, unnumbered paragraph 2, Code 2003,
1 19 is amended to read as follows:
1 20 There is appropriated from the general fund of the state to
1 21 the department of education funds sufficient pursuant to
1 22 section 285.3A to pay the approved claims of public school
1 23 districts for transportation services to nonpublic school
1 24 pupils as provided in this section. The portion of the amount
1 25 appropriated for approved claims under section 285.1,
1 26 subsection 3, shall be determined under section 285.3.
1 27 Sec. 3. NEW SECTION. 285.3A ANNUAL APPROPRIATION.
1 28 There is appropriated for the fiscal year beginning July 1,
1 29 2003, and succeeding fiscal years, the amount of seven million
1 30 nine hundred fifty=five thousand five hundred forty=one
1 31 dollars to be used for payment of claims pursuant to section
1 32 285.2, or for reimbursement pursuant to section 285.3.
1 33 Commencing with the budget year beginning July 1, 2004, and
1 34 succeeding budget years, the amount appropriated for the base
1 35 year shall be increased annually pursuant to section 257.8A by
2 1 an amount corresponding to the state percent of growth
2 2 established for that budget year.
2 3 Sec. 4. Section 301.1, subsection 2, Code 2003, is amended
2 4 to read as follows:
2 5 2. Textbooks adopted and purchased by a school district
2 6 shall, to the extent funds are appropriated by the general
2 7 assembly, be made available to pupils attending accredited
2 8 nonpublic schools upon request of the pupil or the pupil's
2 9 parent under comparable terms as made available to pupils
2 10 attending public schools. If the general assembly
2 11 appropriates moneys The amount appropriated pursuant to
2 12 subsection 4 for purposes of making textbooks available to
2 13 accredited nonpublic school pupils, shall be allocated by the
2 14 department of education shall ascertain the amount available
2 15 to a to each school district for the purchase of nonsectarian,
2 16 nonreligious textbooks for pupils attending accredited
2 17 nonpublic schools. The amount allocated to a school district
2 18 shall be in the proportion that the basic enrollment of a
2 19 participating accredited nonpublic school bears to the sum of
2 20 the basic enrollments of all participating accredited
2 21 nonpublic schools in the state for the budget year. For
2 22 purposes of this section, a "participating accredited
2 23 nonpublic school" means an accredited nonpublic school that
2 24 submits a written request on behalf of the school's pupils in
2 25 accordance with this subsection, and that certifies its actual
2 26 enrollment to the department of education by October 1,
2 27 annually. By October 15, annually, the department of
2 28 education shall certify to the director of revenue and finance
2 29 the annual amount to be paid to each school district, and the
2 30 director of revenue and finance shall draw warrants payable to
2 31 school districts in accordance with this subsection. For
2 32 purposes of this subsection, an accredited nonpublic school's
2 33 enrollment count shall include only students who are residents
2 34 of Iowa. The costs of providing textbooks to accredited
2 35 nonpublic school pupils as provided in this subsection shall
3 1 not be included in the computation of district cost under
3 2 chapter 257, but shall be shown in the budget as an expense
3 3 from miscellaneous income. Textbook expenditures made in
3 4 accordance with this subsection shall be kept on file in the
3 5 school district.
3 6 Sec. 5. Section 301.1, Code 2003, is amended by adding the
3 7 following new subsection:
3 8 NEW SUBSECTION. 4. There is appropriated for the fiscal
3 9 year beginning July 1, 2003, and succeeding fiscal years, the
3 10 amount of five hundred ninety thousand four hundred fifty=
3 11 eight dollars to be made available to pupils attending
3 12 accredited nonpublic schools for textbooks pursuant to this
3 13 section. Commencing with the budget year beginning July 1,
3 14 2004, and succeeding budget years, the amount appropriated for
3 15 the base year shall be increased annually pursuant to section
3 16 257.8A by an amount corresponding to the state percent of
3 17 growth established for that budget year.
3 18 Sec. 6. EFFECTIVE AND APPLICABILITY DATE. This Act, being
3 19 deemed of immediate importance, takes effect upon enactment
3 20 and is applicable for computing state aid for the school
3 21 budget year beginning July 1, 2003.
3 22 EXPLANATION
3 23 This bill provides for an annual increase in the amount of
3 24 state aid appropriated to school districts for designated
3 25 purposes. The bill provides that for the school budget year
3 26 beginning July 1, 2004, and succeeding budget years, the
3 27 amount annually appropriated to school districts for costs
3 28 associated with nonpublic school transportation, nonpublic
3 29 school textbooks, and, if appropriated, for nonpublic school
3 30 technology shall be increased by an amount corresponding to
3 31 the state percent of growth established for that budget year
3 32 pursuant to Code section 257.8. The bill provides that any
3 33 subsequent adjustment or modification to the state percent of
3 34 growth shall also apply to this annual increase. The bill
3 35 provides that the annual increase shall be considered
4 1 miscellaneous income to the school district.
4 2 The bill additionally makes corresponding changes to Code
4 3 provisions relating to appropriations for transportation and
4 4 textbook expenses for nonpublic school pupils, and provides an
4 5 appropriation for the fiscal year beginning July 1, 2003, and
4 6 succeeding fiscal years, for transportation and textbook
4 7 expenses, which shall be subject to the annual percentage
4 8 increase.
4 9 The bill takes effect upon enactment, and is applicable for
4 10 computing state aid for the school budget year beginning July
4 11 1, 2003.
