  1 An Act providing for the term of office of the chief executive
  2    officer of the Iowa public employees' retirement system and
  3    providing an effective and retroactive applicability date.

  1  1    Section 1.  Section 97B.3, subsection 1, Code 2003, is
  1  2 amended to read as follows:
  1  3    1.  The administrator of the division is the chief
  1  4 executive officer.  The chief executive officer shall be
  1  5 appointed by the governor subject to confirmation by the
  1  6 senate and shall serve a four=year term of office beginning
  1  7 and ending as provided in section 69.19.  A vacancy shall be
  1  8 filled for the unexpired portion of the term in the same
  1  9 manner as a full=term appointment is made.  The governor may
  1 10 remove the chief executive officer for malfeasance in office,
  1 11 or for any cause that renders the chief executive officer
  1 12 ineligible, incapable, or unfit to discharge the duties of the
  1 13 office.
  1 14    Sec. 2.  IPERS CHIEF EXECUTIVE OFFICER == TERM OF OFFICE.
  1 15 Notwithstanding any provision of section 97B.3 to the
  1 16 contrary, the term of office for the chief executive officer
  1 17 of the Iowa public employees' retirement system appointed
  1 18 prior to the effective date of this Act shall end April 30,
  1 19 2007.
  1 20    Sec. 3.  EFFECTIVE DATE == RETROACTIVE APPLICABILITY.  This
  1 21 Act, being deemed of immediate importance, takes effect upon
  1 22 enactment and is retroactively applicable to July 1, 2002, and
  1 23 is applicable on and after that date.
  1 24                           EXPLANATION
  1 25    This bill provides that the term of office for the chief
  1 26 executive officer of IPERS is four years.  Pursuant to Code
  1 27 section 69.19, the term of office begins on May 1 of the year
  1 28 of appointment and ends on April 30 of the year of expiration.
  1 29 The bill takes effect upon enactment and is retroactively
  1 30 applicable to July 1, 2002, when the chief executive officer
  1 31 position was created.
  1 32    The bill further provides that the term of office for the
  1 33 IPERS chief executive officer appointed prior to the effective
  1 34 date of the bill shall end April 30, 2007.
