Senate Resolution 173 PAG LIN 1 1 SENATE RESOLUTION NO. ___ 1 2 BY REDFERN 1 3 A Resolution requesting the establishment of an interim 1 4 committee to study and make recommendations related to 1 5 the criminal offense of operating a motor vehicle 1 6 while intoxicated. 1 7 WHEREAS, operating a motor vehicle while 1 8 intoxicated is a serious criminal offense; and 1 9 WHEREAS, the criminal penalties for first, second, 1 10 and third degree operating=while=intoxicated offenses 1 11 are complex, which necessitates the need to uniformly 1 12 and consistently enforce such penalties throughout the 1 13 state; NOW THEREFORE, 1 14 BE IT RESOLVED BY THE SENATE, That the legislative 1 15 council is requested to establish an interim study 1 16 committee to review the criminal penalties provided 1 17 for operating=while=intoxicated offenses. The charge 1 18 of the committee shall include, but is not limited to, 1 19 reviewing the uniformity and consistency of operating= 1 20 while=intoxicated enforcement, including statewide 1 21 application of the law for offenders charged with a 1 22 first, second, or third offense, and for offenders 1 23 with multiple pending charges for operating while 1 24 intoxicated. The committee shall study methods in 1 25 other states and in Iowa to determine the most 1 26 effective methods to reduce recidivism. The committee 1 27 shall also review any federal law or pending federal 1 28 law changes related to operating=while=intoxicated 1 29 offenses. 1 30 BE IT FURTHER RESOLVED, That the members of the 2 1 interim study committee shall include five members of 2 2 the senate and five members of the house of 2 3 representatives. The members of the interim study 2 4 committee shall also include a representative of the 2 5 department of transportation, the department of public 2 6 safety, the county attorneys association, the supreme 2 7 court, mothers against drunk driving, and a 2 8 representative of distributors of ignition interlock 2 9 devices.
