Senate Resolution 119 PAG LIN 1 1 SENATE RESOLUTION NO. 1 2 BY WARNSTADT 1 3 A Resolution urging the United States Department of 1 4 Labor to continue overtime protection for veterans 1 5 who receive specialized military training. 1 6 WHEREAS, many veterans currently working in 1 7 professional fields are entitled to overtime 1 8 protection because they lack a specialized degree 1 9 necessary to be considered a "professional employee" 1 10 as defined under current United States Department of 1 11 Labor regulations; and 1 12 WHEREAS, proposed Department of Labor regulations 1 13 would deny overtime protection to many veterans who 1 14 have received specialized military training by 1 15 treating the military training as equivalent to a 1 16 professional degree; and 1 17 WHEREAS, veterans who lose overtime protection 1 18 would no longer be entitled to additional compensation 1 19 for the overtime hours they work and veterans who rely 1 20 on overtime pay for any significant part of their 1 21 income would suffer a reduction in their standard of 1 22 living; and 1 23 WHEREAS, even though such training has 1 24 traditionally been a recruitment incentive, the 1 25 proposed regulations could actually discourage 1 26 military recruitment because potential recruits may 1 27 expect that the training and experience acquired 1 28 through military service would make them ineligible 1 29 for overtime pay; NOW THEREFORE, 1 30 BE IT RESOLVED BY THE SENATE, That the Senate urges 2 1 the United States Department of Labor to continue 2 2 overtime protection for veterans who receive 2 3 specialized military training; and 2 4 BE IT FURTHER RESOLVED, That, upon adoption, the 2 5 Secretary of the Senate shall prepare an official copy 2 6 of this Resolution and send it to the United States 2 7 Secretary of Labor. 2 8 LSB 6426SS 80 2 9 kk/sh/8
