  1  3      DVORSKY, RAGAN, COURTNEY, DOTZLER, GRONSTAL,
  1  4            STEWART, QUIRMBACH, HATCH, McCOY,
  1  5                   HOLVECK, and BLACK
  1  6 A Resolution to amend Rule 39 of the Rules of the
  1  7    Senate.
  1  8    BE IT RESOLVED BY THE SENATE, That Rule 39,
  1  9 subsections 4, 9, and 10, as adopted by the Senate
  1 10 during the 2003 Session in Senate Resolution 1, are
  1 11 amended to read as follows:
  1 12    4.  The rules adopted by a committee, including
  1 13 subsections 2, 3, 8A, 9, 10, 11, and 12 of this rule,
  1 14 may be suspended by an affirmative vote of a majority
  1 15 of the members of the committee.
  1 16    8A.  A bill or resolution shall not be voted upon
  1 17 unless the committee has held a public hearing called
  1 18 under subsection 10 on that bill or resolution, or has
  1 19 allowed time during a meeting of the committee for
  1 20 public testimony on that bill or resolution.
  1 21    9.  A bill or resolution shall not be voted upon on
  1 22 the same day a public hearing called under subsection
  1 23 10 is held on that bill or resolution, or on the same
  1 24 day public testimony is received under subsection 8A
  1 25 on that bill or resolution.
  1 26    10.  Public hearings may be called at the
  1 27 discretion of the chair.  The chair shall call a
  1 28 public hearing upon the written request of one=half
  1 29 the membership of the committee.  The chair shall set
  1 30 the time and place of the public hearing.  Public
  2  1 testimony may be received at any meeting of a
  2  2 committee, subject to the restriction on voting
  2  3 contained in subsection 9.
