  1  1    Section 1.  Section 455B.133, Code 2003, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  11.  Adopt rules allowing a city to
  1  4 conduct a controlled burn of a demolished building subject to
  1  5 the same restrictions as are in effect for fire fighting
  1  6 training fires.  The rules shall include a provision that a
  1  7 city may undertake no more than five controlled burns in every
  1  8 overlapping six=tenths=of=a=mile=radius circle every three
  1  9 years.  The rules shall prohibit a controlled burn of a
  1 10 demolished building in Cedar Rapids, Marion, Hiawatha, Council
  1 11 Bluffs, Carter Lake, Des Moines, West Des Moines, Clive,
  1 12 Windsor Heights, Urbandale, Pleasant Hill, Buffalo, Davenport,
  1 13 Mason City, or any other area where area=specific state
  1 14 implementation plans require the control of particulate.
  1 15                           EXPLANATION
  1 16    This bill requires the environmental protection commission
  1 17 to adopt rules allowing a city to conduct controlled burns of
  1 18 demolished buildings.  The bill provides that the rules shall
  1 19 include the same restrictions as are in effect for fire
  1 20 fighting training fires.  The bill provides that the rules
  1 21 shall restrict cities to undertake no more than five
  1 22 controlled burns in every overlapping six-tenths-of-a-mile-
  1 23 radius circle every three years.  The bill provides that the
  1 24 rules shall prohibit controlled burns in certain cities and
  1 25 other areas where area=specific state implementation plans
  1 26 require the control of particulate.
