  1  1    Section 1.  WHOLE=GRADE SHARING AGREEMENT DEADLINE WAIVER.
  1  2 Notwithstanding sections 282.10 and 282.11, the department of
  1  3 education may, prior to July 1, 2003, and at the department's
  1  4 discretion, waive any of the deadline requirements of sections
  1  5 282.10 and 282.11, relating to the signing of a whole=grade
  1  6 sharing agreement by the boards of two or more school
  1  7 districts involved in the agreement and the public notice and
  1  8 hearing requirements, if one of the districts involved in the
  1  9 agreement has an enrollment of less than three hundred pupils
  1 10 and has formed a dissolution commission pursuant to section
  1 11 275.51.
  1 12    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 13 immediate importance, takes effect upon enactment.
  1 14                           EXPLANATION
  1 15    This bill provides that the department of education may,
  1 16 prior to July 1, 2003, and at the discretion of the
  1 17 department, waive requirements relating to deadlines for
  1 18 entering into whole=grade sharing agreements, and applicable
  1 19 notice and hearing requirements, as specified in Code sections
  1 20 282.10 and 282.11.  Code section 282.10 provides that a whole=
  1 21 grade sharing agreement shall be signed by the boards of the
  1 22 districts involved in the agreement not later than February 1
  1 23 of the school year prior to the year in which the agreement
  1 24 would go into effect, and Code section 282.11 provides for
  1 25 notice, hearing, and appeal procedures relating to the
  1 26 agreement within specified time frames.
  1 27    The bill provides that the option of a waiver shall be
  1 28 available if one of the school districts which is a party to a
  1 29 whole=grade sharing agreement has an enrollment of less than
  1 30 300 pupils, and has formed a dissolution commission pursuant
  1 31 to Code section 275.51.
  1 32    The bill takes effect upon enactment.
