1 An Act relating to the deposit and use of moneys received by
2 cities and counties for assumption of jurisdiction of primary
3 roads and providing effective and retroactive applicability
4 dates.
5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 306.8, Code 2003, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. Any moneys, and any interest or
1 4 other earnings on the moneys, received by a county or city for
1 5 assumption of jurisdiction of a primary road pursuant to this
1 6 section or otherwise shall be deposited by the county into the
1 7 county's secondary road fund and by the city into a special
1 8 fund or account to be used only for road purposes.
1 9 Sec. 2. IMMEDIATE EFFECTIVE AND RETROACTIVE APPLICABILITY
1 10 DATES.
1 11 1. This Act, being deemed of immediate importance, takes
1 12 effect upon enactment.
1 13 2. This Act applies retroactively to transfers of
1 14 jurisdiction of primary roads occurring on or after January 1,
1 15 2002, for which moneys are received by a county or city on or
1 16 after the effective date of this Act.
1 17 EXPLANATION
1 18 This bill directs counties and cities to deposit any moneys
1 19 received for the assumption of jurisdiction of primary roads
1 20 in the county's secondary road fund or a special fund or
1 21 account established by the city to be used solely for road
1 22 purposes.
1 23 The bill takes effect upon enactment and applies to
1 24 transfers of jurisdiction of primary roads occurring on or
1 25 after January 1, 2002, for which moneys are received on or
1 26 after the effective date of the bill.
