Section 159A.2, Code 2003, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 3A. "Department" means the department of 1 4 agriculture and land stewardship. 1 5 Sec. 2. NEW SECTION. 159A.6C E=85 ETHANOL BLENDED 1 6 GASOLINE PROGRAM. 1 7 The department, including the office, and other agencies of 1 8 this state shall cooperatively establish programs to increase 1 9 the demand for and production and consumption of E=85 ethanol 1 10 blended gasoline as provided in specifications adopted by the 1 11 department pursuant to section 214A.2. 1 12 Sec. 3. Section 214A.2, subsection 3, Code 2003, is 1 13 amended to read as follows: 1 14 3. a. Gasoline with a mixture of less than ten percent 1 15 ethanol shall be known as high=emission gasoline. 1 16 b. Gasoline with a mixture of ten percent or more ethanol, 1 17 but not more than thirteen percent, shall be known as 1 18 conventional blend ethanol. 1 19b.c. Gasoline with a mixture of more than thirteen 1 20 percent ethanol, but not more than twenty=five percent 1 21 ethanol, shall be known as high blend ethanol. For purposes 1 22 of chapters 323A, 422, and 452A, high blend ethanol shall be 1 23 treated as conventional blend ethanol. 1 24c.d. Gasolineshall not containwith a mixture of eighty= 1 25 five percent or morethan twenty=five percentethanol shall be 1 26 known as E=85 ethanol blended gasoline. 1 27 EXPLANATION 1 28 This bill amends Code chapter 159A, which establishes an 1 29 office of renewable fuels and coproducts within the department 1 30 of agriculture and land stewardship. The bill provides that 1 31 the department, including the office, and other agencies of 1 32 this state must establish programs to increase the demand for 1 33 and production and consumption of E=85 ethanol blended 1 34 gasoline. The department regulates specifications relating to 1 35 gasoline, including E=85 pursuant to Code chapter 214A. The 2 1 bill also amends that Code chapter to provide that E=85 2 2 gasoline is gasoline blended with at least 85 percent ethanol. 2 3 LSB 3124SV 80 2 4 da/pj/5
