  1  1    Section 1.  NEW SECTION.  351.44  CRIMINAL LIABILITY FOR
  1  2 DOG FOUND TO HAVE CAUSED PHYSICAL INJURY == RUNNING AT LARGE.
  1  3    1.  A person who owns or has charge of a dog and who allows
  1  4 the dog to run at large after the dog has been found by a
  1  5 court to have caused physical injury to another is guilty of a
  1  6 serious misdemeanor.
  1  7    2.  For the purposes of this section, "at large" means a
  1  8 dog which is not confined on the property of the owner of the
  1  9 dog or on the property of a person who has charge of the dog,
  1 10 in or attached to a motor vehicle, or in a veterinary hospital
  1 11 or kennel, unless the owner or the person who has charge of
  1 12 the dog carries the dog or leads the dog by a leash or chain
  1 13 not exceeding six feet in length.
  1 14                           EXPLANATION
  1 15    This bill creates a criminal offense for a dog owner or a
  1 16 person in charge of a dog who allows the dog to run at large
  1 17 after the dog has been found by a court to have caused
  1 18 physical injury to another.  The bill further defines "at
  1 19 large" to refer to a dog who is not confined on the owner's
  1 20 property or property of the person in charge, in or attached
  1 21 to a motor vehicle, or in a veterinary hospital or kennel,
  1 22 unless the owner or the person in charge of the dog carries
  1 23 the dog or leads it by a leash or chain not exceeding six feet
  1 24 in length.
  1 25    A dog owner who violates the bill commits a serious
  1 26 misdemeanor.  A serious misdemeanor is punishable by
  1 27 confinement for no more than one year and a fine of at least
  1 28 $250 but not more than $1,500.
