1 An Act relating to delegation of the duties of an engineer for
2 certain public improvements by cities and counties.

1 1 Section 1. Section 331.341, subsection 1, Code 2003, is
1 2 amended to read as follows:
1 3 1. When the estimated cost of a public improvement, other
1 4 than improvements which may be paid for from the secondary
1 5 road fund, exceeds the amount specified in section 309.40, the
1 6 board shall follow the contract letting procedures provided
1 7 for cities in sections 384.95 to 384.103 through 384.104.
1 8 However, in following those sections the board shall
1 9 substitute the word "county" for the word "city", section
1 10 331.305 for section 362.3, shall consider "governing body" to
1 11 mean the board, and shall exclude references to a city
1 12 utility, utility board of trustees, or public utilities. As
1 13 used in this section, "public improvement" means the same as
1 14 defined in section 384.95 as modified by this subsection.
1 15 Sec. 2. NEW SECTION. 384.37A DELEGATION OF ENGINEER'S
1 16 DUTIES.
1 17 When the estimated total cost of a public improvement does
1 18 not exceed fifty thousand dollars, the city council may
1 19 delegate the duties of the engineer as specified in this
1 20 division to the city clerk or other public officer or to an
1 21 architect retained by the city.
1 22 Sec. 3. NEW SECTION. 384.104 DELEGATION OF ENGINEER'S
1 23 DUTIES.
1 24 When the estimated total cost of a public improvement does
1 25 not exceed fifty thousand dollars, the city council may
1 26 delegate the duties of the engineer to the city clerk or other
1 27 public officer or to an architect retained by the city.
1 28 EXPLANATION
1 29 This bill provides that if the estimated cost of a public
1 30 improvement does not exceed $50,000, a city council or board
1 31 of supervisors may delegate the duties of an engineer to the
1 32 city clerk or other public officer or to an architect retained
1 33 by the city or county.
