  1  1    Section 1.  Section 249A.30, Code 2003, is amended to read
  1  2 as follows:
  1  3    249A.30  HOME AND COMMUNITY=BASED WAIVER SERVICES
  1  4 REIMBURSEMENT.
  1  5    1.  The base reimbursement rate for a provider of services
  1  6 under a medical assistance program home and community=based
  1  7 waiver for persons with mental retardation shall be
  1  8 recalculated at least every three years to adjust for the
  1  9 changes in costs during the immediately preceding three=year
  1 10 period annually, at the beginning of the fiscal year.
  1 11    2.  The annual inflation factor used to adjust such a
  1 12 provider's reimbursement rate for a fiscal year shall not
  1 13 exceed the percentage increase in the employment cost index
  1 14 for private industry compensation issued by the federal
  1 15 department of labor, bureau of labor statistics, for the most
  1 16 recently completed calendar year be based on the HCFA/SNF
  1 17 index.  For the purposes of this subsection, "HCFA/SNF index"
  1 18 means the health care financing administration total skilled
  1 19 nursing facility market basket index published by data
  1 20 resources, inc.
  1 21                           EXPLANATION
  1 22    This bill provides that reimbursement for providers of
  1 23 services under any medical assistance program home and
  1 24 community=based waivers is to be recalculated, annually, at
  1 25 the beginning of the fiscal year.  The annual inflation factor
  1 26 to be used, instead of the current percentage increase in the
  1 27 employment cost index for private industry compensation issued
  1 28 by the federal department of labor, bureau of labor
  1 29 statistics, for the most recently completed calendar year is
  1 30 to be the HCFA/SNF index.  The "HCFA/SNF index" is defined as
  1 31 the health care financing administration total skilled nursing
  1 32 facility market basket index published by data resources, inc.
