1 An Act providing for the establishment of the state percent of
2 growth for purposes of the state school foundation program,
3 and providing an applicability date.

1 1 Section 1. Section 257.8, subsection 1, Code Supplement
1 2 2003, is amended to read as follows:
1 3 1. STATE PERCENT OF GROWTH. The state percent of growth
1 4 for the budget year beginning July 1, 2003, is two percent.
1 5 The state percent of growth for the budget year beginning July
1 6 1, 2004, is two percent. The state percent of growth for the
1 7 budget year beginning July 1, 2005, is three percent. The
1 8 state percent of growth for each subsequent budget year shall
1 9 be established by statute which shall be enacted within thirty
1 10 days of the submission in the year preceding the base year of
1 11 the governor's budget under section 8.21. The establishment
1 12 of the state percent of growth for a budget year shall be the
1 13 only subject matter of the bill which enacts the state percent
1 14 of growth for a budget year.
1 15 Sec. 2. LEGISLATIVE INTENT. If the revenue estimating
1 16 conference as provided for in section 8.22A agrees to a
1 17 revenue estimate of general fund receipts at its December 2004
1 18 meeting for the fiscal year beginning July 1, 2005, of at
1 19 least four percent over the estimated general fund receipts
1 20 for the fiscal year ending June 30, 2005, it is the intent of
1 21 the general assembly that the general assembly meeting in
1 22 regular session in 2005 shall establish a state percent of
1 23 growth for the budget year beginning July 1, 2005, of four
1 24 percent.
1 25 Sec. 3. Notwithstanding the thirty=day deadline for the
1 26 enactment of the state percent of growth provided in section
1 27 257.8, subsection 1, such deadline shall not apply to the Act
1 28 enacted which establishes the state percent of growth during
1 29 the 2004 Regular Session of the Eightieth General Assembly.
1 30 Sec. 4. APPLICABILITY. This Act is applicable for
1 31 computing state aid under the state school foundation program
1 32 for the school budget year beginning July 1, 2005.
1 33 EXPLANATION
1 34 This bill establishes a state percent of growth of 3
1 35 percent for purposes of the state school foundation program
2 1 for the school budget year beginning July 1, 2005. The bill
2 2 also provides that it is the intent of the legislature that if
2 3 the revenue estimating conference as provided for in Code
2 4 section 8.22A agrees to a revenue estimate of general fund
2 5 receipts at its December 2004 meeting for the fiscal year
2 6 beginning July 1, 2005, of at least 4 percent over the
2 7 estimated general fund receipts for the fiscal year ending
2 8 June 30, 2005, the general assembly meeting in regular session
2 9 in 2005 shall establish a state percent of growth for the
2 10 budget year beginning July 1, 2005, of 4 percent.
2 11 The bill provides that the provisions of Code section
2 12 257.8, subsection 1, establishing a 30=day deadline for the
2 13 enactment of the state percent of growth shall not apply to
2 14 the Act enacted which establishes the state percent of growth
2 15 during the 2004 Regular Session of the Eightieth General
2 16 Assembly.
2 17 The bill is applicable for state aid computation under the
2 18 school foundation program for the school budget year beginning
2 19 July 1, 2005.
