  2    the educational excellence program on a per pupil basis.

  1  1    Section 1.  NEW SECTION.  294A.26  DISTRIBUTION OF
  1  2 PAYMENTS.
  1  3    1.  For the school year beginning July 1, 2005, and
  1  4 succeeding school years, amounts deposited in the educational
  1  5 excellence fund to meet the requirements of this chapter for
  1  6 phase I and phase II pursuant to section 294A.25, subsection
  1  7 6, shall be distributed to school districts on a per pupil
  1  8 basis.  The payments for phase I and phase II shall be
  1  9 combined in making the per pupil distribution.  School
  1 10 districts shall utilize amounts received pursuant to this
  1 11 section for payment of the minimum salary supplement for
  1 12 teachers employed by the district or area education agency as
  1 13 certified to the department of education pursuant to section
  1 14 294A.5, and for payment of amounts required pursuant to phase
  1 15 II.  The department of education shall notify the department
  1 16 of administrative services of the per pupil distribution
  1 17 amount for each school district and the department of
  1 18 administrative services shall make the payments.
  1 19    2.  If the amount distributed to a school district for
  1 20 phase I for a school year is insufficient to pay the amount
  1 21 certified to the department of education pursuant to section
  1 22 294A.5, the school district shall prorate the payments among
  1 23 eligible teachers employed within the district.
  1 24    3.  The amount of compensation received by eligible
  1 25 teachers pursuant to this section for the school year
  1 26 beginning July 1, 2005, shall not be less than the amount
  1 27 received for the school year beginning July 1, 2004.
  1 28    4.  It is the intent of the general assembly that the
  1 29 equitable distribution of funding for the educational
  1 30 excellence program be included in any future legislative
  1 31 interim committee review of the school finance formula.
  1 32    Sec. 2.  Section 294A.6, Code Supplement 2003, is repealed.
  1 33                           EXPLANATION
  1 34    This bill provides for a new distribution mechanism for
  1 35 amounts appropriated for the educational excellence program
  2  1 pursuant to Code chapter 294A.
  2  2    Currently, Code chapter 294A provides that amounts
  2  3 appropriated for phase I of the program shall be distributed
  2  4 to school districts and area education agencies in an amount
  2  5 certified by each district to the department of education
  2  6 corresponding to the number of teachers employed by the
  2  7 district or area education agency whose regular compensation
  2  8 falls below specified minimum levels, and that amounts
  2  9 appropriated for phase II are distributed on a per pupil
  2 10 basis.
  2 11    The bill provides that for the school year beginning July
  2 12 1, 2005, and succeeding school years, amounts deposited in the
  2 13 educational excellence fund for distribution to school
  2 14 districts and area education agencies pursuant to phase I and
  2 15 phase II of the program shall be distributed on a per pupil
  2 16 basis.  The bill provides that the payments for phase I and
  2 17 phase II shall be combined in making the per pupil
  2 18 distribution.  The bill provides that school districts shall
  2 19 utilize the amounts received for payment of the minimum salary
  2 20 supplement for teachers employed by the district or area
  2 21 education agency certified to the department of education
  2 22 pursuant to Code section 294A.5, and for payment of amounts
  2 23 required pursuant to phase II.  The department of education
  2 24 shall notify the department of administrative services of the
  2 25 per pupil distribution amount for each school district, and
  2 26 the department of administrative services shall make the
  2 27 payments.
  2 28    The bill provides that if the amount distributed to a
  2 29 school district for phase I is insufficient to pay the amount
  2 30 certified, the school district shall prorate the payments
  2 31 among eligible teachers employed within the district.
  2 32    The bill provides that the amount of compensation received
  2 33 by eligible teachers for the school year beginning July 1,
  2 34 2005, with the imposition of the new distribution mechanism
  2 35 shall not be less than the amount received for the school year
  3  1 beginning July 1, 2004, and provides intent language including
  3  2 the equitable distribution of funding for the educational
  3  3 excellence program in any future legislative interim committee
  3  4 review of the school finance formula.
  3  5    The bill provides for the repeal of Code section 294A.6,
  3  6 which contains the current provisions regarding the
  3  7 distribution mechanism for phase I.
