1 1 Section 1. Section 714.3, unnumbered paragraph 2, Code
1 2 2003, is amended to read as follows:
1 3 If money or property is stolen from the same person or
1 4 location by two or more acts, or from different persons by two
1 5 or more acts which occur in approximately the same location or
1 6 time period, or from different locations by two or more acts
1 7 within a seventy=two=hour time period, so that the thefts are
1 8 attributable to a single scheme, plan, or conspiracy, these
1 9 acts may be considered a single theft and the value may be the
1 10 total value of all the property stolen.
1 11 EXPLANATION
1 12 This bill allows a modified criminal penalty for certain
1 13 thefts within a 72=hour time period.
1 14 The bill provides that if property is stolen from different
1 15 locations by two or more acts within a 72=hour time period and
1 16 the thefts are attributable to a person or a group of persons
1 17 acting together in a single scheme, plan, or conspiracy, these
1 18 acts may be considered a single theft and the value of the
1 19 thefts may be the total value of all property stolen.
1 20 Under current law in Code section 714.2, the penalty for
1 21 theft depends upon the value of property stolen.
