1 An Act relating to the amount of weighting assigned to certain
2 students.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 225C.40, subsection 1, paragraph d,
1 2 Code 2003, is amended as follows:
1 3 d. The family member is no longer eligible for special
1 4 education pursuant to section 256B.9, subsection 1, paragraph
1 5 "c" or "d" "c", "d", or "f".
1 6 Sec. 2. Section 256B.9, subsection 1, paragraph d,
1 7 unnumbered paragraph 1, Code 2003, is amended to read as
1 8 follows:
1 9 Children requiring special education who have severe
1 10 disabilities or who have multiple disabilities are assigned a
1 11 weighting of four and four=tenths for the school year
1 12 commencing July 1, 1975.
1 13 Sec. 3. Section 256B.9, subsection 1, Code 2003, is
1 14 amended by adding the following new paragraphs:
1 15 NEW PARAGRAPH. f. Children requiring special education
1 16 who have multiple disabilities shall be assigned a cumulative
1 17 weighting comprised of the sum of the weightings to which each
1 18 disability possessed by the child would individually be
1 19 assigned pursuant to this subsection.
1 20 NEW PARAGRAPH. g. Weightings assigned pursuant to this
1 21 subsection shall be in addition to amounts received as
1 22 supplementary weighting pursuant to sections 257.11 and
1 23 257.11A, amounts received for limited English proficiency
1 24 instruction pursuant to section 280.4, or amounts received
1 25 pursuant to any other provision authorizing additional
1 26 weighting for specified purposes.
1 27 EXPLANATION
1 28 This bill relates to the manner in which additional
1 29 weighting for school funding purposes, which is receivable by
1 30 special education students with multiple disabilities or who
1 31 qualify for more than one type of weighting, is authorized or
1 32 calculated.
1 33 The bill provides that children requiring special education
1 34 who have multiple disabilities shall be assigned a cumulative
1 35 weighting comprised of the sum of the weightings to which each
2 1 disability possessed by the child would individually be
2 2 assigned pursuant to Code section 256B.9. Currently, children
2 3 with multiple disabilities are grouped together with children
2 4 with severe disabilities and assigned a weighting of four and
2 5 four=tenths. The bill additionally provides that the
2 6 weightings assigned pursuant to Code section 256B.9 shall be
2 7 in addition to amounts received as supplementary weighting
2 8 pursuant to Code sections 257.11 and 257.11A, amounts received
2 9 for limited English proficiency instruction pursuant to Code
2 10 section 280.4, or amounts received pursuant to any other
2 11 provision authorizing additional weighting for specified
2 12 purposes. The bill includes a reference to the new multiple
2 13 disability weighting in Code section 225C.40, relating to the
2 14 basis for termination of the family support subsidy if a
2 15 family member is no longer eligible for special education.
2 16 Code section 225C.40 currently references the special
2 17 education weighting provisions of Code section 256B.9,
2 18 subsection 1, paragraphs "c" and "d".
