  1  1    Section 1.  NEW SECTION.  142B.6A  LOCAL REGULATION OF
  1  2 SMOKING.
  1  3    1.  In order to minimize the toxic effects of tobacco smoke
  1  4 and to protect the health and well=being of the public, and
  1  5 notwithstanding any conflicting provision of this chapter,
  1  6 local laws and regulations may be adopted to provide for the
  1  7 enforcement, by ordinance or other legal means, of the
  1  8 provisions of this chapter and may establish more specific or
  1  9 stringent controls, additional prohibitions, or increased
  1 10 penalties relating to smoking in a public place.
  1 11    2.  Specifically, a local law may eliminate or limit the
  1 12 exemptions specified in section 142B.2, subsection 1, and in
  1 13 section 142B.2, subsection 3, relating to a bar.
  1 14                           EXPLANATION
  1 15    This bill provides that, in order to minimize the toxic
  1 16 effects of tobacco smoke and to protect the health and well=
  1 17 being of the public, and notwithstanding any conflicting
  1 18 provisions, local laws and regulations may be adopted to
  1 19 provide for the enforcement of the provisions of Code chapter
  1 20 142B and may establish more specific or stringent controls,
  1 21 additional prohibitions, or increased penalties relating to
  1 22 smoking in a public place.  The bill provides that,
  1 23 specifically, a local law may eliminate or limit the
  1 24 exemptions relating to designation of a smoking area and the
  1 25 exemption relating to bars.
