1 An Act relating to landlord disclosure requirements regarding the
2 environmental status of rental property.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 562A.13, Code 2003, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 6. The landlord or a person authorized to
1 4 enter into a rental agreement on behalf of the landlord shall
1 5 disclose to each tenant in writing at or before the
1 6 commencement of the tenancy if any of the following situations
1 7 exists:
1 8 a. The property is listed in the comprehensive
1 9 environmental response compensation and liability information
1 10 system maintained by the federal environmental protection
1 11 agency.
1 12 b. The property is listed on the registry of hazardous
1 13 waste or hazardous substance disposal sites provided for in
1 14 section 455B.426.
1 15 c. The property is enrolled in the land recycling program
1 16 pursuant to section 455H.107.
1 17 Sec. 2. Section 562B.14, Code 2003, is amended by adding
1 18 the following new subsection:
1 19 NEW SUBSECTION. 8. The landlord or a person authorized to
1 20 enter into a rental agreement on behalf of the landlord shall
1 21 disclose to each tenant in writing at or before the
1 22 commencement of the tenancy if any of the following situations

1 24 a. The property is listed in the comprehensive
1 25 environmental response compensation and liability information
1 26 system maintained by the federal environmental protection
1 27 agency.
1 28 b. The property is listed on the registry of hazardous
1 29 waste or hazardous substance disposal sites provided for in
1 30 section 455B.426.
1 31 c. The property is enrolled in the land recycling program
1 32 pursuant to section 455H.107.
1 33 EXPLANATION
1 34 This bill relates to landlord disclosure requirements
1 35 regarding the environmental status of rental property. The
2 1 bill relates to residential leases and manufactured home
2 2 communities or mobile home parks.
2 3 The bill provides that the landlord or a person authorized
2 4 to enter into a rental agreement on behalf of the landlord
2 5 shall disclose to each tenant in writing at or before the
2 6 commencement of the tenancy if the property is listed in the
2 7 comprehensive environmental response compensation and
2 8 liability information system maintained by the federal
2 9 environmental protection agency, the property is listed on the
2 10 registry of hazardous waste or hazardous substance disposal
2 11 sites, or the property is enrolled in the land recycling
2 12 program.
