  1 An Act relating to waiver of penalties for late motor vehicle
  2    registration for activated national guard and reserve forces
  3    members.
  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 321.134, Code 2003, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  5.  The department shall waive the
  1  4 penalties imposed by this section for an owner who, as a
  1  5 member of the Iowa national guard or the reserve forces of the
  1  6 United States, is ordered into active state service, federal
  1  7 service, or state active duty.  The waiver shall apply during
  1  8 the period of activation and for thirty days from the date the
  1  9 period of active military service ends, according to rules
  1 10 adopted by the department.
  1 11                           EXPLANATION
  1 12    This bill requires the state department of transportation
  1 13 to waive penalties for overdue motor vehicle registration fees
  1 14 if the motor vehicle owner is an Iowa national guard or
  1 15 reserve forces member and is called to active state service,
  1 16 federal service, or state active duty.  The penalty waiver
  1 17 applies for 30 days after the end of the period of military
  1 18 activation.
