1 An Act authorizing a county to contract for the performance of
2 certain veterans affairs and general assistance duties.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 35A.3, subsection 12, Code 2003, is
1 2 amended to read as follows:
1 3 12. Provide training to individuals performing the duties
1 4 of executive directors of county commissions of veteran
1 5 affairs pursuant to section 35B.6. The commission may adopt
1 6 rules in accordance with chapter 17A to provide for the
1 7 training of county veteran affairs executive directors.
1 8 Sec. 2. Section 35B.6, subsection 1, Code 2003, is amended
1 9 to read as follows:
1 10 1. a. The members of the commission shall qualify by
1 11 taking the usual oath of office, and give bond in the sum of
1 12 five hundred dollars each, conditioned for the faithful
1 13 discharge of their member duties with sureties to be approved
1 14 by the county auditor. The commission shall organize by the
1 15 selection of one of their members commission member as
1 16 chairperson, and one as secretary. The commission, subject to
1 17 the approval of the board of supervisors, shall have power to
1 18 may employ an executive director and other necessary
1 19 administrative or clerical assistants when needed, the or may
1 20 contract for the performance of the executive director or
1 21 assistants' duties. The compensation of such employees to or
1 22 the contract amount, as applicable, shall be fixed by the
1 23 board of supervisors, but no a member of the commission shall
1 24 not be so employed in any of the positions or paid under the
1 25 contract. The individual fulfilling the duties of the
1 26 executive director must possess the same qualifications as
1 27 provided in section 35B.3 for commission members. However,
1 28 this qualification requirement shall not apply to a person an
1 29 individual employed as an executive director prior to July 1,
1 30 1989.
1 31 b. Upon the employment of an executive director, the
1 32 executive director shall complete a course of initial training
1 33 provided by the commission of veterans affairs pursuant to
1 34 section 35A.3. If an executive director is not appointed, a
1 35 commissioner, or a clerical assistant, or individual
2 1 designated by contract to perform the executive director
2 2 duties shall complete the course of training. The commission
2 3 shall issue the executive director, commissioner, or clerical
2 4 assistant, or individual a certificate of training after
2 5 completion of the initial training course. To maintain annual
2 6 certification, the executive director, commissioner, or
2 7 clerical assistant, or individual shall attend one commission
2 8 training course each year. Failure to maintain certification
2 9 may be cause for removal from office. The expenses of
2 10 training shall be paid from the appropriation authorized in
2 11 section 35B.14.
2 12 Sec. 3. Section 252.26, Code 2003, is amended to read as
2 13 follows:
2 14 252.26 GENERAL ASSISTANCE DIRECTOR.
2 15 The board of supervisors in each county shall appoint or
2 16 designate a general assistance director for the county, who
2 17 shall have the powers and duties conferred by this chapter.
2 18 In lieu of appointing or designating a general assistance
2 19 director, the board of supervisors may contract for
2 20 performance of the director's duties. In counties of one
2 21 hundred thousand or less population, the county board may
2 22 designate as general assistance director an employee of the
2 23 state department of human services who is assigned to work in
2 24 that county and is directed by the director of human services,
2 25 pursuant to an agreement with the county board, to exercise
2 26 the functions and duties of general assistance director in
2 27 that county. The director shall receive as compensation an
2 28 amount to be determined by the county board.
2 29 Sec. 4. Section 331.321, subsection 1, paragraph h, Code
2 30 2003, is amended to read as follows:
2 31 h. A general assistance director in accordance with
2 32 section 252.26. In lieu of appointment, the board may
2 33 contract for performance of the director's duties as provided
2 34 in section 252.26.
2 35 EXPLANATION
3 1 This bill authorizes a county to contract for the
3 2 performance of certain veterans affairs and general assistance
3 3 duties.
3 4 Code section 35A.3, relating to the duties of the state
3 5 commission of veterans affairs, is amended to provide that the
3 6 requirement to provide training to executive directors of
3 7 county commissions of veterans affairs applies to individuals
3 8 performing the executive director's duties.
3 9 Code section 35B.6, relating to qualification, training,
3 10 and offices of a county commission of veterans affairs, is
3 11 amended to allow the commission, with the approval of the
3 12 board of supervisors, to contract for performance of the
3 13 executive director's duties or the duties of any assistant.
3 14 Code section 252.26, relating to the general assistance
3 15 director, is amended to allow the county board of supervisors
3 16 to contract for performance of the general assistance
3 17 director's duties in lieu of appointing or designating the
3 18 director.
3 19 Code section 331.321, relating to the appointments required
3 20 to be made by the county board of supervisors, is amended to
3 21 conform with the bill's authorization for a board to contract
3 22 for performance of the duties of a county general assistance
3 23 director.
