  1  1    Section 1.  Section 135.61, subsection 14, paragraph f,
  1  2 Code 2003, is amended by striking the paragraph.
  1  3    Sec. 2.  Section 135.61, subsection 20, Code 2003, is
  1  4 amended to read as follows:
  1  5    20.  "Organized outpatient health facility" means a
  1  6 facility, not part of a hospital, organized and operated to
  1  7 provide health care to noninstitutionalized and nonhomebound
  1  8 persons on an outpatient basis; it does not include birth
  1  9 centers, private offices or clinics of individual physicians,
  1 10 dentists or other practitioners, or groups of practitioners,
  1 11 who are health care providers.
  1 12    Sec. 3.  Section 135.63, subsection 2, Code 2003, is
  1 13 amended by adding the following new paragraph:
  1 14    NEW PARAGRAPH.  q.  A birth center or services provided by
  1 15 a birth center that is not affiliated with a birthing
  1 16 hospital.
  1 17                           EXPLANATION
  1 18    This bill exempts birth centers and services provided by
  1 19 birth centers that are not affiliated with birthing hospitals
  1 20 from the certificate of need process.  The bill specifically
  1 21 excludes birth centers from the definition of an "organized
  1 22 outpatient health facility" which facilities are subject to
  1 23 the certificate of need process.
