  3    applicable.

  1  1    Section 1.  Section 462A.12, Code Supplement 2003, is
  1  2 amended by adding the following new subsection:
  1  3    NEW SUBSECTION.  14.  A person shall not operate a vessel
  1  4 on the waters of this state unless every person on board the
  1  5 vessel who is under thirteen years of age is wearing a type I,
  1  6 II, III, or V personal flotation device that is approved by
  1  7 the United States coast guard while the vessel is under way.
  1  8 This subsection does not apply when the person under thirteen
  1  9 years of age is in a part of the vessel that is fully
  1 10 enclosed, where such enclosure will prevent such person from
  1 11 falling out of or being thrown from the vessel.
  1 12                           EXPLANATION
  1 13    This bill adds a new provision to Code section 462A.12
  1 14 concerning prohibited operations of certain vessels.  The bill
  1 15 provides that a person shall not operate a vessel on the
  1 16 waters of this state unless every person on board who is under
  1 17 13 years of age is wearing a type I, II, III, or V personal
  1 18 flotation device that is approved by the United States coast
  1 19 guard while the vessel is under way.  The new provision does
  1 20 not apply when the person under 13 years of age is in a part
  1 21 of the vessel that is fully enclosed, where the enclosure will
  1 22 prevent that person from falling out of or being thrown from
  1 23 the vessel.
  1 24    For a violation of this provision, there is a scheduled
  1 25 fine of $25, pursuant to Code section 805.8B, subsection 1,
  1 26 paragraph "c".
