1 An Act relating to the speed limit for vehicles with a gross
2 weight exceeding ten thousand pounds on divided, multilaned
3 highways.

1 1 Section 1. Section 321.285, subsection 6, Code 2003, is
1 2 amended to read as follows:
1 3 6. a. Notwithstanding any other speed restrictions, the
1 4 speed limit for all vehicular traffic on fully controlled=
1 5 access, divided, multilaned highways including the national
1 6 system of interstate highways interstate road system is sixty=
1 7 five miles per hour, except that the speed limit on such
1 8 highways for vehicles with a gross weight exceeding ten
1 9 thousand pounds is fifty=five miles per hour. The department
1 10 may establish a speed limit of sixty=five miles per hour on
1 11 certain divided, multilaned highways, except that the speed
1 12 limit for vehicles with a gross weight exceeding ten thousand
1 13 pounds shall not exceed fifty=five miles per hour.
1 14 b. However, the The department, or cities a city with the
1 15 approval of the department, may establish a lower speed limit
1 16 upon such highways on a highway described in this subsection
1 17 that is located within the corporate limits of a city. For
1 18 the purposes of this subsection, a fully controlled=access
1 19 highway is a highway that gives preference to through traffic
1 20 by providing access connections with selected public roads
1 21 only and by prohibiting crossings at grade or direct private
1 22 driveway connections.
1 23 c. A minimum speed may be established by the department on
1 24 the highways referred to in this subsection if warranted by
1 25 engineering and traffic investigations.
1 26 d. It is further provided that any Any kind of vehicle,
1 27 implement, or conveyance incapable of attaining and
1 28 maintaining a speed of forty miles per hour shall be
1 29 prohibited from using the interstate road system.
1 30 e. For the purposes of this subsection, a fully
1 31 controlled=access highway is a highway that gives preference
1 32 to through traffic by providing access connections with
1 33 selected public roads only and by prohibiting crossings at
1 34 grade or direct private driveway connections.
1 35 EXPLANATION
2 1 This bill reduces the maximum allowable speed limit to 55
2 2 miles per hour on divided, multilaned highways, including
2 3 controlled=access highways and interstate highways, for
2 4 vehicles with a gross weight exceeding 10,000 pounds. The
2 5 bill retains the current 65 mile per hour speed limit
2 6 allowable for other vehicles traveling on such highways.
