  1 An Act relating to bicycles on primary highways and providing a
  2    penalty.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 321.234, Code 2003, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  2A.  Notwithstanding subsection 2, a
  1  4 person shall not ride a bicycle on the roadway portion of a
  1  5 four=lane, divided primary highway if a multipurpose
  1  6 recreational trail or a paved shoulder designated as a bikeway
  1  7 runs parallel to the roadway and is adjacent to or within the
  1  8 highway right=of=way.  This subsection applies to primary
  1  9 highways outside municipal corporate boundaries.  This
  1 10 subsection does not apply at times when the recreational trail
  1 11 or bikeway is impassable.  This subsection does not apply to
  1 12 persons who are participating in a scheduled bicycle ride with
  1 13 an organized group that has given advance notice to the
  1 14 department and the Iowa state patrol, in accordance with rules
  1 15 adopted by the department.
  1 16    Sec. 2.  Section 805.8A, subsection 9, Code Supplement
  1 17 2003, is amended to read as follows:
  1 18    9.  BICYCLE OR PEDESTRIAN VIOLATIONS.  For violations by a
  1 19 pedestrian or a bicyclist under section 321.234, subsections
  1 20 2A, 3, and 4, section 321.236, subsection 10, section 321.257,
  1 21 subsection 2, section 321.275, subsection 8, section 321.325,
  1 22 321.326, 321.328, 321.331, 321.332, 321.397, or 321.434, the
  1 23 scheduled fine is fifteen dollars.
  1 24                           EXPLANATION
  1 25    This bill prohibits a person from riding a bicycle on a
  1 26 four=lane, divided primary highway if there is a multipurpose
  1 27 recreational trail or a paved shoulder designated as a bikeway
  1 28 running parallel to the roadway.  The prohibition applies to
  1 29 primary highways outside municipal corporate boundaries.  The
  1 30 bill creates an exception for times when the trail or bikeway
  1 31 is impassable.  Also, the prohibition does not apply to
  1 32 persons participating in an organized, scheduled ride if the
  1 33 group has notified the state department of transportation and
  1 34 the Iowa state patrol in advance, according to administrative
  1 35 rules.
  2  1    The scheduled fine for a violation is $15.
