1 An Act relating to the installation of certain aboveground
2 petroleum storage tanks.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 101.12, Code 2003, is amended to read
1 2 as follows:
1 3 101.12 ABOVEGROUND PETROLEUM TANKS AUTHORIZED.
1 4 Rules of the state fire marshal permitting installation of
1 5 aboveground petroleum storage tanks for retail motor vehicle
1 6 fuel outlets shall be in substantial compliance with the
1 7 applicable standards of the national fire protection
1 8 association, and shall be subject to the approval of the
1 9 governing body of the local governmental subdivision with
1 10 jurisdiction over the site of the outlet. The state fire
1 11 marshal shall deem installation of an aboveground petroleum
1 12 storage tank with a capacity greater than or a storage use
1 13 other than that given in the applicable standards of the
1 14 national fire protection association to be in substantial
1 15 compliance if a professional engineer licensed in the state
1 16 provides written certification that the standards of the
1 17 national fire protection association other than tank capacity
1 18 or storage use have been substantially met. The installation
1 19 shall be subject to the approval of the governing body of the
1 20 local governmental subdivision with jurisdiction over the
1 21 site.
1 22 EXPLANATION
1 23 This bill relates to the installation of certain
1 24 aboveground petroleum storage tanks.
1 25 The bill provides that the state fire marshal shall deem
1 26 installation of an aboveground petroleum storage tank with a
1 27 capacity greater than or a storage use other than that given
1 28 in the applicable standards of the national fire protection
1 29 association to be in substantial compliance if a professional
1 30 engineer licensed in the state provides written certification
1 31 that the standards of the national fire protection association
1 32 other than tank capacity or storage use have been
1 33 substantially met. The installation shall be subject to the
1 34 approval of the governing body of the local governmental
1 35 subdivision with jurisdiction over the site.
