Section 321.234, Code 2003, is amended by 1 2 adding the following new subsection: 1 3 NEW SUBSECTION. 2A. Notwithstanding subsection 2, a 1 4 person shall not ride a bicycle on the roadway portion of a 1 5 four=lane, divided primary highway if a designated bicycle 1 6 trail, including a paved shoulder designated as a bikeway, 1 7 runs parallel to the roadway and is adjacent to or within the 1 8 highway right=of=way. This subsection applies to primary 1 9 highways outside municipal corporate boundaries. 1 10 Sec. 2. Section 805.8A, subsection 9, Code Supplement 1 11 2003, is amended to read as follows: 1 12 9. BICYCLE OR PEDESTRIAN VIOLATIONS. For violations by a 1 13 pedestrian or a bicyclist under section 321.234, subsections 1 14 2A, 3, and 4, section 321.236, subsection 10, section 321.257, 1 15 subsection 2, section 321.275, subsection 8, section 321.325, 1 16 321.326, 321.328, 321.331, 321.332, 321.397, or 321.434, the 1 17 scheduled fine is fifteen dollars. 1 18 EXPLANATION 1 19 This bill prohibits a person from riding a bicycle on a 1 20 four=lane, divided primary highway if there is a designated 1 21 bicycle trail, including a paved shoulder designated as a 1 22 bikeway, running parallel to the roadway. The prohibition 1 23 applies to primary highways outside municipal corporate 1 24 boundaries.
