Section 483A.7, subsection 3, Code 2003, is 1 2 amended to read as follows: 1 3 3. A nonresident wild turkey hunter is required to have a 1 4 nonresident hunting license and a nonresident wild turkey 1 5 hunting license and pay the wildlife habitat fee. The 1 6 commission shall annually limit totwothree thousandthree1 7 five hundred licenses the number of nonresidents allowed to 1 8 have wild turkey hunting licenses. Of thetwothree thousand 1 9threefive hundred licenses, one hundred fifty licenses shall 1 10 be valid for hunting with muzzle loading shotguns only. The 1 11 commission shall allocate the nonresident wild turkey hunting 1 12 licenses issued among the zones based on the populations of 1 13 wild turkey. A nonresident applying for a wild turkey hunting 1 14 license must exhibit proof of having successfully completed a 1 15 hunter safety and ethics education program as provided in 1 16 section 483A.27 or its equivalent as determined by the 1 17 department before the license is issued. 1 18 Sec. 2. Section 483A.8, subsections 3 and 5, Code 2003, 1 19 are amended to read as follows: 1 20 3. A nonresident hunting deer is required to have a 1 21 nonresident hunting license and a nonresident deer license and 1 22 must pay the wildlife habitat fee. The commission shall 1 23 annually limit toeighttwelve thousandfive hundredlicenses 1 24 the number of nonresidents allowed to have any sex deer 1 25 hunting licenses.Of the first six thousand nonresident deer 1 26 licenses issued, not more than thirty=five percent of the 1 27 licenses shall be bow season licenses and, after the first six 1 28 thousand nonresident deer licenses have been issued, all 1 29 additional licenses shall be issued for antlerless deer only.1 30 An additional two thousand five hundred nonresident antlerless 1 31 only deer licenses shall be made available for issuance. The 1 32 commission shall allocate the nonresident deer hunting 1 33 licenses issued among the zones based on the populations of 1 34 deer.However, a nonresident applicant may request one or 1 35 more hunting zones, in order of preference, in which the 2 1 applicant wishes to hunt. If the request cannot be fulfilled, 2 2 the applicable fees shall be returned to the applicant.A 2 3 nonresident applying for a deer hunting license must exhibit 2 4 proof of having successfully completed a hunter safety and 2 5 ethics education program as provided in section 483A.27 or its 2 6 equivalent as determined by the department before the license 2 7 is issued. 2 8 5.A nonresident owning land in this state may apply for 2 9 one of the first six thousand nonresident deer licenses not 2 10 limited to antlerless deer, and the provisions of subsection 3 2 11 shall apply. However, ifIf a nonresident owning land in this 2 12 state is unsuccessful in obtaining one of thefirst six 2 13 thousandnonresident any sex deer licenses provided for in 2 14 subsection 3, the landowner shall be given preference for one 2 15 of thetwo thousand five hundrednonresident antlerless only 2 16nonresidentdeer licenses provided for in subsection 3. A 2 17 nonresident owning land in this state shall pay the fee for a 2 18 nonresident antlerless only deer license and the license shall 2 19 be valid to hunt on the nonresident's land only. A 2 20 nonresident owning land in this state is eligible for only one 2 21 nonresident deer license annually. If one or more parcels of 2 22 land have multiple nonresident owners, only one of the 2 23 nonresident owners is eligible for a nonresident antlerless 2 24 only deer license. If a nonresident jointly owns land in this 2 25 state with a resident, the nonresident shall not be given 2 26 preference for a nonresident antlerless only deer license. 2 27 The department may require proof of land ownership from a 2 28 nonresident landowner applying for a nonresident antlerless 2 29 only deer license. 2 30 EXPLANATION 2 31 This bill increases the annual limit on nonresident turkey 2 32 hunting licenses from 2,300 to 3,500. 2 33 The bill increases the number of nonresident deer hunting 2 34 licenses available from 8,500 to 14,500, and provides that 2 35 there will be 12,000 annual nonresident any sex deer hunting 3 1 licenses available, and 2,500 annual nonresident antlerless 3 2 only deer licenses available. The statutory requirement that 3 3 only 35 percent of the nonresident deer hunting licenses shall 3 4 be sold to bow and arrow hunters is stricken. 3 5 The bill provides that a nonresident owning land in this 3 6 state who is unsuccessful in the nonresident any sex deer 3 7 hunting license drawing has preference to receive a 3 8 nonresident antlerless only deer hunting license. 3 9 LSB 1498SS 80 3 10 av/sh/8
