  1 An Act relating to the establishment of a public charter school
  2    pilot program and providing effective and applicability dates.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 256F.3, subsection 1, as enacted by
  1  2 2002 Iowa Acts, chapter 1124, section 3, is amended to read as
  1  3 follows:
  1  4    1.  Commencing with the school year beginning July 1, 2002,
  1  5 the The state board of education shall apply for a federal
  1  6 grant under Pub. L. No. 107=110, cited as the federal No Child
  1  7 Left Behind Act of 2001 (Title V, Part B, Subpart 1), for
  1  8 purposes of providing financial assistance for the planning,
  1  9 program design, and initial implementation of public charter
  1 10 schools.  The department shall initiate a pilot program to
  1 11 test the effectiveness of charter schools and shall implement
  1 12 the applicable provisions of this chapter.
  1 13    Sec. 2.  Section 256F.4, subsections 1 and 3, as enacted by
  1 14 2002 Iowa Acts, chapter 1124, section 4, are amended to read
  1 15 as follows:
  1 16    1.  Within fifteen days after approval of a charter school
  1 17 application submitted in accordance with section 256F.3,
  1 18 subsection 2, a school board shall report to the department
  1 19 the name of the charter school applicant entry, the proposed
  1 20 charter school location, and its projected enrollment.
  1 21    3.  A charter school shall not discriminate in its student
  1 22 admissions policies or practices on the basis of intellectual
  1 23 or athletic ability, measures of achievement or aptitude, or
  1 24 status as a person with a disability.  However, a charter
  1 25 school may limit admission to students who are within a
  1 26 particular range of age ages or grade level levels or on any
  1 27 other basis that would be legal if initiated by a school
  1 28 district.  Enrollment priority shall be given to the siblings
  1 29 of students enrolled in a charter school.
  1 30    Sec. 3.  Section 256F.11, as enacted by 2002 Iowa Acts,
  1 31 chapter 1124, section 11, is amended to read as follows:
  1 32    SEC. 11.  NEW SECTION.  256F.11  FUTURE REPEAL.
  1 33    This chapter is repealed effective July 1, 2010 2011.
  1 34    Sec. 4.  2002 Iowa Acts, chapter 1124, section 12, is
  1 35 amended by striking the section and inserting in lieu thereof
  2  1 the following:
  2  2    SEC. 12.  Section 257.31, subsection 5, paragraph d, Code
  2  3 2003, is amended to read as follows:
  2  4    d.  The closing of a nonpublic school, wholly or in part,
  2  5 or the opening or closing of a pilot charter school.
  2  6    Sec. 5.  2002 Iowa Acts, chapter 1124, section 13, is
  2  7 amended by striking the section and inserting in lieu thereof
  2  8 the following:
  2  9    SEC. 13.  Section 282.18, subsection 4, paragraph b, Code
  2 10 2003, is amended to read as follows:
  2 11    b.  For purposes of this section, "good cause" means a
  2 12 change in a child's residence due to a change in family
  2 13 residence, a change in the state in which the family residence
  2 14 is located, a change in a child's parents' marital status, a
  2 15 guardianship or custody proceeding, placement in foster care,
  2 16 adoption, participation in a foreign exchange program, or
  2 17 participation in a substance abuse or mental health treatment
  2 18 program, a change in the status of a child's resident district
  2 19 such as removal of accreditation by the state board, surrender
  2 20 of accreditation, or permanent closure of a nonpublic school,
  2 21 revocation of a charter school contract as provided in section
  2 22 256F.8, the failure of negotiations for a whole=grade sharing,
  2 23 reorganization, dissolution agreement or the rejection of a
  2 24 current whole=grade sharing agreement, or reorganization plan.
  2 25 If the good cause relates to a change in status of a child's
  2 26 school district of residence, however, action by a parent or
  2 27 guardian must be taken to file the notification within forty=
  2 28 five days of the last board action or within thirty days of
  2 29 the certification of the election, whichever is applicable to
  2 30 the circumstances.
  2 31    Sec. 6.  2002 Iowa Acts, chapter 1124, section 14, as
  2 32 amended by 2002 Iowa Acts, chapter 1175, section 96, is
  2 33 amended to read as follows:
  2 34    SEC. 14.  EXPEDITED APPLICATION PROCEDURE.  The state board
  2 35 of education shall develop an expedited charter school
  3  1 application procedure for the fiscal year beginning not later
  3  2 than July 1, 2002 2004, for purposes of receiving distributing
  3  3 federal planning funds issued pursuant to the federal
  3  4 Elementary and Secondary Education Act of 1965, Title X, Part
  3  5 C, as codified in 20 U.S.C. }} 8061=8067.
  3  6    Sec. 7.  2002 Iowa Acts, chapter 1124, section 16, is
  3  7 amended by striking the section and inserting in lieu thereof
  3  8 the following:
  3  9    SEC. 16.  APPLICABILITY DATE.  This Act applies on the date
  3 10 by which the department of education initiates implementation
  3 11 in accordance with the provisions of section 256F.3,
  3 12 subsection 1.  The department of education shall notify the
  3 13 Code editor upon initiating implementation in accordance with
  3 14 this section and section 256F.3, subsection 1.
  3 15    Sec. 8.  EFFECTIVE DATE.  This Act, being deemed of
  3 16 immediate importance, takes effect upon enactment.
