Section 56.5A, Code 2003, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 3. a. A candidate's committee shall 1 4 accept contributions from sources other than voters registered 1 5 within the county or counties represented in whole or in part 1 6 by the office to which the candidate presently seeks election, 1 7 only to the extent that the candidate's committee has received 1 8 and deposited in the candidate's campaign account an equal or 1 9 greater total of contributions from voters registered within 1 10 the county or counties represented in whole or in part by the 1 11 office to which the candidate presently seeks election. 1 12 b. A candidate who accepts a contribution in violation of 1 13 this subsection shall be subject to a civil penalty in an 1 14 amount equal to ten times the amount by which the contribution 1 15 exceeded the permitted limit. The civil penalty proceeds 1 16 shall be deposited in the Iowa election campaign fund created 1 17 by section 56.19. 1 18 c. Section 56.16 shall not apply to this subsection. 1 19 EXPLANATION 1 20 This bill amends Code chapter 56 to limit a candidate's 1 21 committee in the amount of contributions accepted from sources 1 22 other than registered voters living in counties in whole or in 1 23 part within the candidate's district. A candidate can accept 1 24 funds from nonresidents only to the extent that the candidate 1 25 has collected an equal or greater amount of funds from voters 1 26 registered in counties in whole or in part within the 1 27 candidate's district. The penalty for violation of this 1 28 prohibition is a civil penalty equal to 10 times the amount 1 29 accepted in excess of the limitation. 1 30 The criminal misdemeanor penalty generally applicable to 1 31 violations of Code chapter 56 does not apply to this new 1 32 provision. 1 33 LSB 1814SS 80 1 34 jj/cf/24.1 1 35
