  1  1    Section 1.  Section 728.1, Code 2003, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  11.  "Sexual content telephone card" means
  1  4 a product which permits the cardholder to access over the
  1  5 telephone a service which describes sex acts, prohibited sex
  1  6 acts, or obscene material for a predetermined amount of time.
  1  7    Sec. 2.  NEW SECTION.  728.13  PROMOTING A SEXUAL CONTENT
  1  8 TELEPHONE CARD TO A MINOR.
  1  9    A person who knowingly promotes a sexual content telephone
  1 10 card to a minor commits a serious misdemeanor.
  1 11                           EXPLANATION
  1 12    This bill creates a criminal offense for promoting a sexual
  1 13 content telephone card to a minor.  The bill defines "sexual
  1 14 content telephone card" to mean a product which permits the
  1 15 cardholder to access over the telephone a service which
  1 16 describes sex acts, prohibited sex acts, or obscene material
  1 17 for a predetermined amount of time.  "Promote" is defined in
  1 18 Code section 728.1.
  1 19    A person who commits a violation of the bill is guilty of a
  1 20 serious misdemeanor.  A serious misdemeanor is punishable by
  1 21 confinement for no more than one year and a fine of at least
  1 22 $250 but not more than $1,500.
